Case Synopsis & Summary

This Kerala High Court judgment arises from OP(KAT) 292 of 2015 challenging the Kerala Administrative Tribunal OA 134/2013. The petitioner, I.V. Chandran, was an Audit Officer (Higher Grade) in the Kerala Local Fund Audit Service who had availed Leave Without Allowances during probation and rejoined later. The central questions are (a) whether the benefit of the earlier period of probation can be counted after re-joining, and (b) whether, on re-joining, he should be considered for promotion over juniors before his probation in the promoted post is declared. The Tribunal decided the first question in his favour, stating that he need only complete the balance of his probation after rejoining, and it held that on seniority, promotions to the higher grade would be determined only after probation is declared, treating those promoted earlier as senior. The government relied on the Kerala Local Fund Audit Service Special Rules 2008, arguing that there is no promotion to Audit Officer (Higher Grade) without probation being declared. The court distinguishes Mohammed Abdulla v. State of Kerala (SC) 2008, on the basis that Mohammed Abdulla concerned the older 1960 special rules, whereas the present case is governed by the 2008 rules, which require probation declaration. Consequently, the court upholds the Tribunal and dismisses the petition, with no order as to costs. It also notes that the 2008 rules list eight categories; probation is required for all except Audit Officer (Higher Grade), and Rule 6 mandates probation for every appointment, reinforcing the conclusion.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner’s counsel relied on Mohammed Abdulla v. State of Kerala (2008) 1 KLT 712 (SC) to argue that probation rules can grant seniority and promotion rights despite leave during probation. The government contends that Special Rules 2008 regulate Local Fund Audit Service and require declaration of probation for promotion to Audit Officer (Higher Grade). The applicant joined Local Fund Audit in 1987, took LWA 2006-2009, rejoined and was promoted (31.05.2009) but his probation declaration occurred much later (2010-04-07). The State argues that only upon declaration of probation can promotion to the higher grade occur, and that the 1st proviso to Rule 28(a) and Rule 6 of the 2008 Rules govern this. The Tribunal’s reasoning relied on the earlier path and the seniority list; the High Court distinguishes Mohammed Abdulla due to replacement by the 2008 Special Rules, which limit the applicability of that decision.

Contentions of Respondents

The respondents argued that the Kerala Local Fund Audit Service Special Rules 2008 clearly require probation to be declared before promotion to the higher grade; the eight-category structure ensures that Audit Officer (Higher Grade) cannot be promoted without probation; they emphasize the 1st proviso to Rule 28(a) and the importance of the government’s final seniority lists; thus the petition should be dismissed and the Tribunal's order sustained.

The petitioners probation in the cadre of Audit Officer was declared by Annexure A7 order dated 20.04.2011 with effect from 07.04.2010. The learned Counsel for the petitioner places reliance on the cited decision of** _**Mohammed Abdulla**_ **(supra) to contend that even in the case of the applicant, Rule 4 of Appendix XII A of the Kerala Service Rules applied. We have no quarrel with that, insofar as the applicant's juniors being promoted, only during the period of leave, retaining their seniority in the higher post. If it was left at that, definitely, the applicant could have been promoted to the post of Audit Officer(Higher Grade) on re-joining duty after the leave availed,** _**dehors**_ **his declaration of probation in the post of Audit officer having not been declared.** **7. But, however, in the present case, we see the fundamental difference is insofar as the State service being regulated by Special Rules for the Kerala Local Fund Audit Service issued as per S.R.O No.650/2008 produced in the OA as Annexure** **O.P(KAT) No. 292 of 2015 - 6 -** **A13. We pertinently notice that in the cited decision what came up for consideration is the Kerala Local Fund Audit Service Special Rules 1960.** **8. As per the Special Rules of 2008, there** **are 8 categories in the State service starting from Office Superintendents and in the ascending order of the promotional hierarchy ending with Director of Local Fund Audit. The petitioner was in the post of Audit officer when he proceeded on leave; within two months of his appointment, admittedly when he had not completed probation in the post of Audit Officer. We take note of Rule 6 of the Special Rules of 2008 which provides for probation for every persons appointed to 8 categories except category no.5 Audit Officer(Higher Grade). Hence without probation being declared in the post of Audit Officer there can be no promotion to the post of Audit** **O.P(KAT) No. 292 of 2015 - 7 -** **Officer(Higher Grade). The Tribunal also found that the petitioner cannot avail the benefit of the 1[st] proviso to Rule 28(a) since he was on leave without allowance when the period for completion of probation in the post of Audit Officer expired. We perfectly agree with the reasoning of the Tribunal.** **In such circumstance we do not think that the challenge is sustainable and we reject the original petition upholding the order of the Tribunal.
