Court Decision / Holding
OT.Rev.No. 7 of 2017 & CONNECTED CASES disposed of with mixed outcomes: revisions 9/2017, 10/2017 and 14/2017 are partly allowed, particularly on the x-ray films issue in favour of the assessee; revisions 7/2017, 11/2017 and 13/2017 are rejected. The common thread is that Form-8B can bar ITC for the purchases in question, and the decision emphasizes that several issues are fact-intensive and revolve around hospital services as a composite offering.
Final Disposition
Partly allowed and partly rejected (some revisions allowed on x-ray/consumables issues; others rejected).

Case Synopsis & Summary

This batch of Kerala High Court revisions concerns the denial of input tax credit (ITC) under the Value Added Tax regime for purchases made by Holy Cross Hospital Pvt. Ltd. The petitioner hospital challenged orders of the Value Added Tax Appellate Tribunal (PKD bench) that reversed the First Appellate Authority and denied ITC on invoices issued in Form-8B, on the ground that such invoices indicate no ITC and that the goods were last sale to a consumer or otherwise used as consumables. The court treats the Form-8B regime as a bar to ITC for the disputed purchases. A linked issue involves the taxability of x-ray films, which the court recognises as part of para-medical services and thus not easily separable from a hospital’s service package; in a batch of revisions (9/2017, 10/2017, 14/2017) the court partly allows the x-ray question in favour of the assessee and against the revenue, while revisions 7/2017, 11/2017 and 13/2017 are rejected. The decision underscores factual aspects of consumable use and hospital service delivery, and notes that some questions are purely factual and do not admit a uniform answer. The bench, comprising K. Vinod Chandran and Ashok Menon, ultimately disposes of the connected revisions with mixed outcomes, reflecting the nuanced treatment of ITC and para-medical services under the Kerala VAT framework.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contended that denial of ITC based on Form-8B invoices was unfounded since the hospital discharged output tax and the inputs were used in rendering services. They argued that the Form-8B regime does not automatically bar ITC where goods are essential to hospital operations, and that evidence showed purchases used for services rather than final sale to consumers. They also submitted that the x-ray services and other para-medical activities form part of a composite hospital service and should not be treated as ordinary sales. The ITC denial on consumables should be examined on factual grounds, and the Tribunal’s reversal of the First Appellate Authority should be reconsidered in light of the factual matrix. Respondents: The Revenue contended that Form-8B explicitly indicates no ITC for the cited invoices, and that hospital purchases primarily relate to inputs for final sale or for consumables, which the tax regime should not permit ITC for where last sale to a consumer is involved. They argued that the Tribunal’s conclusion was warranted and that the hospital’s evidence did not establish consumables usage in a manner that would entitle ITC. They asserted that x-ray films are integral to diagnostic services and that tax treatment should follow the para-medical service framework.

Contentions of Respondents

The Revenue argued for strict application of Form-8B and the last-sale concept, maintaining that the ITC denial was correct where invoices suggest no ITC, and that the hospital’s consumable usage for patient care does not automatically grant ITC; on x-ray films, they claimed they constitute services rather than separate goods, aligning with the Tribunal’s view and the Full Bench’s approach.

On the said question raised it has to be found that Form-8B indicates that there can be no input tax credit available, insofar as the purchases made under the said invoice, which is deemed to be one of last sale to the consumer. In such circumstances, we do not find any infirmity, insofar as the Tribunal having reversed the order of the first Appellate Authority and found the input tax ## **OT.Rev.No. 7 of 2017 & CONNECTED CASES** **8** credit claimed to be not sustainable. We answer the question against the assessee and in favour of the Revenue. 3. The learned counsel for the assessee, Sri.A.Kumar would submit that a question regarding use of consumables in the hospital would arise, insofar as the declaration made by the Full Bench in _**2019 (1) KLT 336 [Sanjose**_ ## _**Parish Hospital v. Commercial Tax Officer].**_ 4. The learned Senior Government Pleader Sri.Shamsudheen however would contend that the issue was considered by the Assessing Officer as also the statutory authorities. Wherever evidence was produced, it was allowed by the Assessing Officer. The Tribunal also specifically found that the invoices were not produced and there was nothing to show the purchase being of consumables, which are put to use in the ## **OT.Rev.No. 7 of 2017 & CONNECTED CASES** **9** hospital. We agree that the question raised is one purely on facts and calls for no answer. Interference declined to the order of the Tribunal. 5. One other question, which arises is as to the exigibility of tax of x-ray films. This question has been already considered by us in a batch of writ petitions against the revenue. Taking of X-rays is a part of the services offered in a hospital and is an activity to diagnose the specific ailment of the patient. There is no sale discernible nor can the transfer of such X-ray films in the course of para-medical services offered be separated from the composite service offered in an hospital as held by the Full Bench.
