## **JUDGMENT**
## **[ WP(C).38543/2017, WP(C).41910/2017 ] Dated this the 16th day of November 2020**
The petitioner is a builder. The petitioner owns 287.93 cents of property comprised in Re-survey Nos.21/1, 21/2 and 21/3 of Olavanna Village within Olavanna Grama Panchayat.
2. The petitioner approached the Panchayat with an application dated 20.12.2014 to construct a shopping mall. The Panchayat forwarded the said application before the Chief Town Planner. The Chief Town Planner by proceedings dated 07.11.2015 granted permission and approved the plan. The Panchayat had not granted formal permission. The petitioner appears to have started construction.
3. In the revenue records, the land is described as a _nilam._ It is for the reason that the petitioner did not regularize the land in accordance with the Kerala Land Utilisation Order, 1967 (for short, 'KLU Order'), the Panchayat delayed to grant the formal permit.
4. The petitioner moved an application on 10.05.2017 under the KLU before the Revenue Divisional Officer, Kozhikode. An order was passed on 03.07.2017. The permission
**WP(C)Nos.38543 & 41910 of 2017 5**
was declined stating that there is no permission under the KLU to utilise the land for commercial purposes.
5. The writ petition was filed before this Court challenging the order of the Sub Collector as above. That order was set aside by this Court in W.P.(C) No.23093/2017 and directed the Sub Collector to consider the application afresh. Thereafter, the Sub Collector passed an order on 20.11.2017. The application has been rejected by the Sub Collector on the reason that on an examination of the satellite images it was observed that the land was cultivated with paddy prior to 2008. However, it was noted that the land was not included in the data bank. It is also observed that any reclamation of the land would adversely affect ecology and the environment. This order is under challenge in W.P.(C) No.41910/2017.
6. At the time of the admission, this Court granted an interim order permitting the petitioner to complete the construction at the risk of the petitioner. That was challenged by the Panchayat before the Division Bench in W.A.No.481 of 2018. The said writ appeal was dismissed noting that the land in question is not included in the data bank.
**WP(C)Nos.38543 & 41910 of 2017 6**
7. The petitioner also filed W.P.(C) No.38543/2017. This writ petition was filed when steps were taken by the Local Level Monitoring Committee(LLMC) to include the land in the data bank. Exts.P19 and P20 are the proceedings of the Village Officer and the LLMC respectively. This Court granted an interim stay as against the proceedings.
8. There is no dispute to the fact that the petitioner had completed the construction. There is also not a dispute to the fact that the Panchayat had also assigned building number for first phase.
9. The issue will have to be decided based on the proposed action to include the land in the data bank.
10. Therefore, it is appropriate to advert the pleadings in W.P.(C) No.38543/2017 at first. Ext.P19 in W.P.(C) No.38543/2017 is the intimation given by the Village Officer to the petitioner. It is stated in Ext.P19 that the land in Re-survey No.21/1 was converted in 2007. It is further stated that in the land in Re-survey No.21/2, there was a house in the year 2007 with land having an extent of 11.56 cents. It is further stated that the rest of the land in Re-survey Nos.21/2 and 21/3 will have to be included in the data bank.
**WP(C)Nos.38543 & 41910 of 2017 7**
In fact, this communication is in tune with the decision of LLMC in their proceedings dated 01.08.2017 produced as Ext.P20.
11. The point arose in this case for resolution in the context of the decision of LLMC to include the land in Resurvey Nos.21/2 and 21/3 except 11.5 cents in Re-survey No.21/2 in the data bank. That decision was taken on 1.8.2017.
12. There is no dispute to the fact that the petitioner had submitted an application in the year 2014. There is also no dispute to the fact that the petitioner started construction much before LLMC took a decision. There is also no dispute to the fact that at the time of submitting the application for building permit, the land was not included in the data bank. Therefore, it is clear that even if the petitioner had not obtained any permission under KLU, that construction could not be declared as illegal (See the judgment of this Court in **Aishabeevi and Another v. Superintendent of Police, Ernakulam and Others [2014 (3) KHC 678** ].
**WP(C)Nos.38543 & 41910 of 2017 8**
13. LLMC has the necessary power to include and exclude any land in the data bank. In the proceedings of LLMC, a reference has been made as to the satellite images of the land in question. Based on this, a decision was taken as above to include the land in the data bank.
14. The report of the Kerala State Remote Sensing and Environment Centre (KSREC), produced as Ext.P17. The observation and conclusion of the land in the report is as follows:
## _“Survey No.21/1:_
_The entire area of the survey plot was observed predominantly under mixed vegetation/plantation in the imagery of 04.06.2007(Fig.4). The same trend of landuse was continued in the imagery of 03.02.2011(fig.5). The entire area of the plot was observed under building/structure in the image of 14.01.2014(Fig.6) and the same trend was continued in the imageries of 11.03.2016(Fig.7)._
## _Survey No.21/2:_
_The entire area of the survey plot was observed predominantly under mixed vegetation/plantation and fallow in between with one structure in the south east corner of the plot in the imagery of 04.06.2007(fig.4). The same trend of landuse was continued in the imageries of 03.02.2011(fig.5). From the image of 14.01.2014(fig.6), it was observed that_
**WP(C)Nos.38543 & 41910 of 2017 9**
_vegetation/plantation were reduced in the western region of the plot. Entire area of the plot was observed under building/structure in the imageries of 11.03.2016(Fig.7)._
## _Survey Number 21/3:_
_The entire area of the survey plot was observed predominantly under mixed vegetation/plantation in the image of 04.06.2007(fig.4). The same trend of landuse was continued in the imagery of 03.02.2011(fig.5). From the image of 14.01.2014(fig.6), it was observed that mixed vegetation/plantation were reduced in the western region of the plot. Entire area of the plot was observed under construction activities with building/structure towards the southern region building/structure in the imageries of 11.03.2016(Fig.7)_ .
15. In the report itself, it is stated that the data in the year 2008 was not available. If the report is read as a whole, it would be seen that the land was predominantly under mixed vegetation/plantation. There was a building in Re-survey No.21/2. This report has to be read in the light of the earlier decision of LLMC not to include the land in the data bank. The land was excluded for the reason that it was predominantly occupied by vegetation or plantation. The same land cannot be included without forming an opinion, the land was fit for cultivation of paddy. Further, LLMC was aware of the
**WP(C)Nos.38543 & 41910 of 2017 10**
construction undertaken by the petitioner. A building permit application was submitted in the year 2014. The Chief Town Planner granted necessary permission in the year 2015. The entire land is lying contiguous as a single plot. LLMC's report also does not indicate that the land was fit for cultivation of paddy atleast in the year 2014. In the proceedings of LLMC, it was observed that the land was predominantly planted with coconut trees. The satellite images also do not support the decision of LLMC to include the land in the data bank. The Act 28 of 2008 came into force with effect from 12.08.2008. LLMC woke up from slumber to take a decision to include the land on 01.08.2017 after nine years. This Court, in such circumstances, cannot take such decision of LLMC with any of the seriousness.
16. The learned Government Pleader defended the decision of LLMC stating that LLMC was convinced the land predominantly remained as a paddy except coconut trees along the side of the bund.
17. That apart, there is another legal bar for LLMC to take up the matter for inclusion. The petitioner had approached this Court in W.P.(C) No.23093 of 2017. That writ
**WP(C)Nos.38543 & 41910 of 2017 11**
petition was filed challenging the order of the Sub Collector declining the permission under KLU. LLMC was party to the proceedings. This Court directed to consider the application by the Sub Collector treating that the land is not included in the data bank. Similarly, W.A.No.481 of 2018 was filed as against the interim order in W.P.(C) No.41910 of 2017. The Division Bench noted that the land is not included in the data bank. In the light of the directions given by this Court, any decision which would change the very foundation of the judgment of this Court requires review of those directions.
18. The present exercise now attempted by LLMC not only have no factual foundation but also run counter to the earlier decisions and directions of this Court. In such circumstances, I am of the view that the impugned proceedings in W.P.(C) No.38543 of 2017 have to be set aside. Accordingly, it is set aside.
19. In view of the setting aside the proceedings challenging in W.P.(C) No.38543 of 2017, there is no difficulty in disposing W.P.(C) No.41910 of 2017. That writ petition was filed challenging the decision of the Sub Collector, Kozhikode dated 20.11.2017. A permission was declined stating that
**WP(C)Nos.38543 & 41910 of 2017 12**
regularization would adversely affect the ecology and environment. The power under KLU conferred on the Collector to command the holder of the land to cultivate with crops which were in cultivation. If the land in question is not required for cultivation, necessarily, the Collector has to give necessary permission to utilize the land for other purposes. The Collector is not an authority to decide upon the matters related to ecology and environment in exercise of his power under KLU. Further, the cultivation of the crop in the land was paddy. After the Act 28 of 2008 came into force if the land is not included as paddy in the data bank, the Collector cannot exercise any power under Clause 7 of the Kerala Land Utilisation Order to command the holder to cultivate with paddy. The Division Bench of this Court in **Praveen v. Land Revenue Commissioner [2010(2) KLT 617]** held that after the Act 28 of 2008 came into force the entire matter will have to be dealt with under the Act 28 of 2008. That means, if the land is not included in the data bank, the Collector inevitably has to grant permission as there is a declaration that the land is unfit for paddy cultivation by way of non-inclusion of the same in the data bank.
**WP(C)Nos.38543 & 41910 of 2017 13**
20. In that view of the matter, the impugned order has to be set aside. Accordingly, it is set aside. Since no other reason has been assigned by the Collector for declining the permission and this order has been passed as a continuation of the earlier order of rejection, I am of the view that the petitioner need not be relegated again to the Collector for permission under KLU. The impugned order, therefore, in W.P. (C) No.41910 of 2017 has to be modified granting permission. Accordingly, the Panchayat is directed to act upon the application for building permit/regularization, if any, in accordance with law. Needful shall be done by the Panchayat within one month. If the building has been completed in accordance with the building permit, there is no bar for the Panchayat to issue an occupancy certificate in accordance with law.
The writ petitions are disposed of as above.
