Case Synopsis & Summary

The petitioner GTL Infrastructure Limited approached this Court under Article 226 of the Constitution seeking police protection to prevent illegal obstruction by respondents 4–8 to the construction of a mobile telecom tower in accordance with Ext.P1, the building permit issued by Kandanassery Grama Panchayat. The petitioner contends that the Panchayat’s attempt to revoke Ext.P1 has failed as recorded in Ext.P6, and that respondents 5–7 and the additional 10th respondent have no legal right to impede the tower’s erection, especially since the permit remains valid. Respondents 5–7 and the added 10th respondent argue that the tower would cause health hazards and public inconvenience, including to St. Mary’s Convent LP School. Respondents 1–4, through the government pleader, rely on the necessity of lawfully protecting the petitioner’s right to construct. A counsel for R9 emphasises the legally valid nature of the permit. The court, applying the holdings in Essar Telecom Infrastructure cases, concludes that the petitioner is entitled to police protection to proceed with construction. The writ petition is allowed; the court directs respondents 1–4 to provide protection strictly in accordance with Ext.P1 and subject to the observations and conditions in Essar. The IA for impleadment of an additional respondent is disposed of as per order. The decision aligns with established telecom infrastructure jurisprudence.

The petitioner has come to this Court seeking issue of directions under Article 226 of the Constitution of India to respondents 1 to 4 to afford police protection to the petitioner against illegal obstruction caused by respondents 4 to 8 against the construction of a telecommunication tower as per building permit issued by the 9[th] respondent panchayat produced as Ext.P1. According to the petitioner, though an attempt was made by the 9[th] respondent panchayat to revoke the permit, that attempt has now failed with the order of the Tribunal for Local Self Government Institutions. Respondents 5 to 7, local residents, are unnecessarily raising objections and causing obstructions, it is submitted. During the pendency of this W.P(c) No.34239 of 2011 2 petition, additional 10[th] respondent has got itself impleaded. The 8[th] respondent has subsequently been deleted from the array of parties on the request of the petitioner. 2. According to the petitioner, Ext.P1 permit is now valid. The petitioner is entitled to undertake the construction on the basis of Ext.P1. Respondents 5 to 7 or additional 10[th] respondent have no manner of right to obstruct the construction of the tower. Respondents 5 to 7 and additional 10[th] respondent raised objections against the construction of the tower solely on the ground that the construction of the tower will cause health hazards and inconvenience to the members of the local public and the school. That is not a legally valid or tenable objection. Police are not acting in accordance with law to permit the petitioner to undertake construction. It is, in these circumstances, that the petitioner has come to this Court with this petition. 3. A counsel appears for respondents 5 to 7 and additional 10[th] respondent. The counsel reiterates the objection that the construction of the tower would cause health hazards to members of the local community and the local school. 3 W.P(c) No.34239 of 2011 4. A counsel appears for the 9[th] respondent. The learned counsel submits that though the panchayat had wanted to revoke Ext.P1 permit issued by the panchayat, that attempt has now failed in the light of Ext.P6 judgment of the Tribunal for Local Self Government Institutions. The permit is legally valid. 5. Our attention has been drawn to the precedents in **Essar Telecom Infrastructure (P) Ltd. v. C.I of Police** [2010 (2) KLT 762] and **Essar Telecom Infrastructure (P) Ltd. v. State of Kerala** [2011 (2) KHC 171]. The learned counsel for the petitioner prays that in these circumstances no valid objection can be raised to the prayer made in this petition. 6. We have considered all the relevant inputs. We agree with the learned counsel for the petitioner that in the light of the precedents referred above, the petitioner is certainly entitled to for police protection. 7. In the result: a) This Writ Petition is allowed; b) Respondents 1 to 4 are directed to afford protection to the petitioner to construct a mobile tower strictly in accordance with Ext.P1 permit issued by the 9[th] respondent; 4 W.P(c) No.34239 of 2011 c) Needless to say, the direction hereby issued shall be subject to all observations and conditions in **Essar Telecom Infrastructure (P) Ltd. v. State of Kerala** [2011 (2) KHC 171]. **(R.BASANT, JUDGE)** **(K.SURENDRA MOHAN, JUDGE)** rtr/ 5 W.P(c) No.34239 of 2011 # **R.BASANT & K.SURENDRA MOHAN, JJ. ************************* ## **I.A.No.9479 of 2011 in W.P(C) No.34239 of 2010-D** ## ********************************* Dated this the 17[th] day of June, 2011 ## **ORDER** ## BASANT, J.
