Case Synopsis & Summary

These original petitions under Article 227 of the Constitution challenge orders that condoned delays in filing applications for determination of compensation under Rule 5 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Rules, 1963 (PMP Rules). The crucial issue is whether Section 5 of the Limitation Act, 1963 can be invoked to extend the outer time limit of 90 days prescribed in Rule 5. The petitioners contend the PMP Rules form a special statute, and the 90-day outer limit should exclude the Limitation Act; they rely on Omana Kunjamma v. Deputy Collector and Competent Authority (Kerala) (2019) 1 KLT 949 and Petronet CCK Ltd. v. Vijayan (2005) 1 KLT 773 to argue that Section 5 is applicable. The respondents counter that Section 5 should apply, arguing the Limitation Act governs the period, and point to the Gujarat High Court decision Gail (India) Ltd. v. Commanding Officer (2016 GLH (2) 7). The court ultimately endorses Omana Kunjamma (holding that Section 5 can be applicable) but dismisses the petitions, stating that the field ratio is unsettled by the Supreme Court’s pending Special Leave Petition, and thus the petitions are to be dismissed with the bundle of authorities guiding the ratio in Omana Kunjamma.

Submissions & Arguments

Contentions of Appellants / Petitioners

The applicants contend that Rule 5 of the PMP Rules fixes an outer time limit of ninety days for filing an application to determine compensation, and this period is to be understood as excluding the provisions of the Limitation Act. They rely on Omana Kunjamma v. Deputy Collector and Competent Authority (Kerala) (2019) 1 KLT 949, which held that Section 5 of the Limitation Act is maintainable for invoking Rule 5. They also point to Petronet CCK Ltd. v. Vijayan (2005) 1 KLT 773, which the Division Bench relied upon, and argue that the apex Court has not stayed these decisions, though Special Leave Petitions are pending. The core argument is that Section 5 should apply to condone delay in filing under Rule 5, aligning with a broader interpretation of the deprivation of rights due to procedural delays.

Contentions of Respondents

The respondents contend that Section 5 of the Limitation Act squarely applies and can be invoked to condone delays in filing under Rule 5 PMP Rules. They assert that the 90-day outer limit is to be understood in light of the Limitation Act and that the Gujarat High Court in Gail (India) Ltd. v. Commanding Officer (2016 GLH (2) 7) has taken a contrary view. They urge that the constitutional scheme permits reasonable periods for filing and that the Rule 5 outer limit should be harmonized with Section 5. They rely on the Gujarat decision to argue that the Limitation Act governs and that delay can be condoned under Section 5.

M/s.Gail (India) Ltd is aggrieved in the matter of allowing condonation of delay in filing the original petitions under Rule 5 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Rules, 1963 (for short 'PMP Rules'). The power of the District Judge to condone the delay in filing an application for determination of compensation under Rule 5 of the PMP Rules by invoking Section 5 of the Limitation Act is the pertinent question herein to be decided. For clarity, Rule 5 of the PMP Rules is extracted as under; _“5. Application to the District Judge for determination of compensation.- Any party aggrieved by the determination of the amount of compensation may prefer an application to the District Judge within_ ## **O.P.(C) Nos.546, 547, 549, 551, 552, 554 and 557 OF 2022 9** _the limits of whose jurisdiction the land or any part thereof is situated, not later than ninety days of the receipt of the intimation from the competent authority under rule 4(3)”_ 2. It is submitted by the learned counsel for the petitioners that the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 being a special statute, the expression “not later than ninety days” in Rule 5, providing the outer time limit within which the application has to be filed before the District Judge, excludes the provisions of the Limitation Act. 3. The learned counsel for the other side zealously opposed their contention and submitted that Section 5 of the Limitation Act squarely would apply in these matters. 4. In this context, reference to a decision of a Division Bench of this Court in **Omana Kunjamma V. Deputy Collector and Competent Authority (Kerala)** [2019 (1) KLT 949] **O.P.(C) Nos.546, 547, 549, 551, 552, 554 and 557 OF 2022 10** is necessary. Therein it has been held that an application under Section 5 of the Limitation Act, 1963 is maintainable for invoking Rule 5 of the PMP Rules. Therein, the Division Bench approved the decision of the learned Single Judge of this Court in _**Petronet CCK Ltd. v.**_ _**Vijayan**_ [2005(1) KLT 773] and disagreed with the contrary view taken by the Gujarat High Court in _**Gail (India) Ltd. v. Commanding**_ _**Officer**_ [2016 GLH (2) 7]. 5. Whereas, the learned counsel for the petitioners submitted that, as against the decision in _**Omana Kunjamma**_ (Supra), the petitioners had preferred Special Leave Petition before the Hon'ble Supreme Court and the same is pending consideration. But the learned counsel fairly conceded that no stay is there in the said matter. 6. Thus it has to be held that the decision of the Division Bench of this Court in _**Omana**_ _**Kunjamma**_ (Supra) will hold the field, until the **O.P.(C) Nos.546, 547, 549, 551, 552, 554 and 557 OF 2022 11** said ratio is unsettled by the Apex Court. Therefore, these Original Petitions are liable to be dismissed, confirming the finding in the impugned orders following the ratio in _**Omana Kunjamma**_ (Supra). However, it is made clear that the final decision on the question as to whether Section 5 of the Limitation Act can be made applicable to an application under Rule 5 of the PMP Rules will depend upon the outcome of the Special Leave Petition pending before the Hon'ble Supreme Court. Accordingly, with the above observation, these Original Petitions are dismissed. Sd/- ## **A.
