Case Synopsis & Summary
This bail application is filed under Section 438 CrPC by 18 accused in Crime No. 662/2020 of Nadapuram Police Station, Kozhikode. The case pertains to offences under Sections 143, 147, 148, 452, 294(b), 506, 323, 324 r/w 149 IPC, arising from an incident on 27.9.2020 where the accused, along with 10 others, allegedly formed an unlawful assembly, trespassed into the complainant’s house, damaged property with an iron rod, and assaulted the complainant and his wife due to a dispute linked to elopement. The petitioners seek pre-arrest bail under Sec. 438 CrPC. Counsel for petitioners contends that only the offence under Section 452 IPC is non-bailable; the incident is connected to Crime 664/2020, for which bail was granted in BA 7902/2020; the petitioners are willing to comply with stringent conditions. The Public Prosecutor opposes bail, noting the connection to 664/2020 and the seriousness of the allegations, yet concedes social distancing considerations in prisons in light of the COVID-19 pandemic. The court cites the principles that bail is the general rule and jail the exception, citing Chidambaram P. v. Directorate of Enforcement, and relies on Supreme Court and Kerala Full Bench guidelines on COVID-19 to fashion its order. Ultimately, the bail application is allowed subject to nine conditions, including appearance before IO, bond and sureties, travel restrictions, passport surrender, no further offences, and adherence to COVID-19 guidelines; non-compliance may lead to cancellation of bail.

Submissions & Arguments
Contentions of Appellants / Petitioners
Counsel for petitioners contended that only one non-bailable offence is involved (Section 452 IPC) and that the broader incident is linked to Crime 664/2020, with a bail already granted in BA 7902/2020. They asserted willingness to comply with strict conditions and social distancing norms, citing the general principle that bail is the rule and detention is the exception, and urging the court to grant bail to enable fair trial.
Contentions of Respondents
State opposing bail emphasized the connection to Crime 664/2020 and the serious nature of the offences, while acknowledging the COVID-19 context; the State urged the court to consider stringent conditions if bail is granted, balancing public order and the rights of the accused.
