Case Synopsis & Summary
The petitioner, E. C. Indira, was an approved Part Time Music Teacher at the 4th respondent’s aided U.P. School, Kozhikode. Her post was converted to Full Time in 1992, with a subsequent reconversion back to Part Time with effect from 15.7.1992 by Ext. P1, issued by the Director of Public Instructions. Pursuant to Ext. P1, the Assistant Educational Officer directed the Headmaster to recover the excess amount paid to the petitioner. The petitioner challenged these moves and had earlier approached this Court in O.P. No. 18065/1995; she then filed Ext. P3 for revision. While the revision petition was pending, she retired on 31.3.2007. Ext. P6 disposed of the revision, confirming Exts. P1 and P2. Subsequently, Ext. P7 directed withholding an amount from the petitioner’s DCRG as gratuity. The petitioner seeks certiorari to quash Exts. P1, P2 and P6 to the extent against her and mandamus to disburse pensionary benefits with interest in case of delay. The Court notes the lack of a Full Time post after 15.7.1992 and relies on Rajiv v. State of Kerala to reject the limitations argument when Rule 12E(3) of Chapter XXIII of the Kerala Education Rules is invoked. The Court holds Exts. P2 and P6 to the extent they direct recovery from the petitioner unsustainable, and directs release of the withheld DCRG amount, if solely withheld under Ext. P6, within two months. The writ petition is disposed of accordingly.

Submissions & Arguments
Contentions of Appellants / Petitioners
The petitioner contends there was no Full Time post with effect from 15.7.1992 and that the mistake should have been corrected in the same academic year; having not done so, the mistake cannot be corrected later. Relying on Rajiv v. State of Kerala (2009(4) KLT 802), she argues limitation is not applicable when the Director of Public Instructions uses Rule 12E(3) powers, and she seeks release of the amount withheld from the DCRG.
Contentions of Respondents
The respondents contend there was an irregular conversion creating a financial liability to the exchequer. Ext. P1 directed recovery from the AO; Ext. P2 wrongly directed recovery from the petitioner; Ext. P6 endorsed recovery; the DPI’s orders require recovery from the AO, not from the petitioner. The authorities seek to sustain Exts. P2 and P6 or to remedy the impropriety within the revision framework.
