Case Synopsis & Summary

This batch of writ petitions challenges Circular No.46848/P1/2016/Revenue dated 22.12.2016 issued by the Government of Kerala, which restricted the conversion of land under the Kerala Land Utilisation Order, 1967 (KLU Order) for construction of residential buildings, limiting to 10 cents in Panchayats and 5 cents in Municipalities/Corporations. The petitioners contend that the circular unduly curtails legitimate use and that Clause 6 applications filed before the District Collectors should be processed in accordance with law. The court recalls that Shivadasan v. Revenue Divisional Officer had set aside the circular, and it reiterates that a citizen may pursue conversion where permissible and supported by the existing regulatory framework. It also cites Revenue Divisional Officer v. Jalaja Dileep (SC) to underscore the principle of legitimate use for conversion of land under the KLU Order. The judgment directs that the District Collectors consider the Clause 6 applications within two months from certified copy of the judgment, with a report from the Local Level Monitoring Committee (LLMC) on the lie and nature of the land and whether it is recorded in the Data Bank under the Paddy Land and Wet Land Act, 2008; if included, its description must be clarified. Post-conversion, petitioners may pursue garden land/tax reclassification as per Kizhakkambalam DB v. Mariumma. The petitions are disposed with costs to be borne by the petitioners.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners challenge Circular No.46848/P1/2016/Revenue dated 22.12.2016 under the Kerala Land Utilisation Order, 1967, which restricts conversion of land for construction of residential buildings. They rely on the data bank entries under the Paddy Land and Wet Land Act, 2008 and on the decision in Shivadasan to argue that the circular should be set aside for Clause 6 conversions where legitimate use exists. Exhibit P6 shows the application under Clause 6; they seek processing of such applications by the District Collector with appropriate LLMC input.

Contentions of Respondents

The respondents argue for adherence to the circular and regulatory checks governing land conversion, emphasizing that the circular provides safeguards against inappropriate land-use changes. They contend that the District Collectors must exercise caution in processing Clause 6 applications. The court notes, however, that Shivadasan has set aside the circular and directs subsequent processing consistent with that direction."
