Case Synopsis & Summary

This Regular First Appeal (RFA No. 13 of 2006) before the Kerala High Court concerns a dispute over a 10-cent plaint schedule property in Eriyad village, initially filed as OS 76/97 for cancellation of sale deed No. 669/93 and for partition. The appellant-plaintiff, Devaky, is shown to have died during the pendency of the appeal; her legal heirs have been impleaded as Addl. Appellants 2 to 4, namely Thankam, Radhamani, and Sushama. The matter was ultimately settled out of court through a mediation process, resulting in an agreement dated 11.10.2021 (Annexure I) to sell the property and divide the sale proceeds among the parties. The petition filed under Order 23 Rule 3 read with Sec. 151 CPC seeks to record this compromise as part of a compromise decree. The court notes that the entire dispute has been amicably settled and disposed of the appeal in terms of the compromise. The judgment records that the compromise will form part of the decree, and the appellant is exempted from paying court fees in view of a precedent cited from a Madras High Court decision (as reported in 2021 (2) KHC 62). The order underscores that the conclusion is based on the settlement arrived at by the parties and is effective without further adversarial litigation.

Submissions & Arguments

Contentions of Appellants / Petitioners

The applicants contend that the entire dispute, arising from OS 76/97 (cancellation of sale deed and partition) has been amicably settled through mediation, evidenced by the original agreement dated 11.10.2021. They seek to record the compromise under Order 23 Rule 3 CPC and to incorporate the compromise decree into the final judgment, leaving no room for further litigation. Since the settlement is out of court, they also rely on a precedent allowing exemption from court fees.

Contentions of Respondents

The respondents join in the settlement and support recording the compromise; there is no ongoing dispute beyond the mediation agreement, and the appeal is to be disposed of in terms of that agreement.
