Case Synopsis & Summary

Two Criminal Misc. Cases (Crl.M.C. Nos. 7061/2023 and 7074/2023) were heard by the Kerala High Court at Ernakulam, before a single judge, Justice Gopinath P. The petitions originate from Crime Nos. 934/2020 and 935/2020 of Kumily Police Station, under which criminal proceedings were pending as ST Nos. 307/2020 and 317/2020 before the Grama Nyayalaya at Azhutha, Peermade Taluk. The petitioners (Lijo George and Jijo George in 7061; Reji Sebastian, Jerin Jacob and Jessy Reji in 7074) sought quashing of all further proceedings, on grounds that the disputes with the respective defacto complainants had been settled and that the defacto complainants no longer wish to continue the prosecutions. The respondents, including the State and the police, along with the defacto complainants, supported the settlement. After hearing the parties, the Court held that there is no public interest in continuing proceedings where a settlement exists and that, given the nature of the offences, quashing on the basis of settlement is permissible under Section 482 Cr.P.C., following the principles in Gian Singh v. State of Punjab and State of Madhya Pradesh v. Laxmi Narayan. Accordingly, the petitions were allowed and all further proceedings were quashed against the petitioners in both cases.

Provisions of Law Cited

Section 294(b) IPCSection 323 IPCSection 451 IPCSection 506(1) IPCSection 34 IPCSection 482 Cr.P.C.

Legal Doctrines & Maxims

  • Settlement as a ground to quash criminal proceedings under Cr.P.C. 482 (Gian Singh v. State of Punjab)
  • Quashing of criminal proceedings on settlement in light of public interest considerations (State of Madhya Pradesh v. Laxmi Narayan)

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contended that all issues with the defacto complainants have been resolved amicably; the defacto complainants do not wish to continue with the prosecution; continued proceedings would not serve public interest; reliance was placed on the power under Section 482 Cr.P.C. to quash on settlement, guided by Gian Singh and Laxmi Narayan.

Contentions of Respondents

The respondents supported the settlement, noting that the defacto complainants do not desire continued prosecution; the court’s inherent power under Cr.P.C. 482 can be exercised in light of settlement; no contrary public interest is evident in continuing with the proceedings.
