Case Synopsis & Summary

This is a criminal miscellaneous case filed in the Kerala High Court by accused persons (petitioners) in CC No. 579 of 2015 arising from Crime No. 158 of 2015 (Poovar Police Station). The petition challenges the final report/charge sheet under Section 482 Cr.P.C. The court notes that the prosecution alleges the accused defied an order of the High Court and violated orders against temple activities connected with the Irupaikonam Sree Bhagavathi Temple, resulting in offences under IPC Sections 143, 147, 149, 188, and 109 and under the Kerala Police Act, 2011 (Section 39 r/w 121(2) and 117(e)). The FIR was lodged by the Sub Inspector of Police, but under Section 195(1)(a)(i) Cr.P.C. such a complaint must be by the issuing public servant or a subordinate, making the 188 IPC charge untenable. The absence of produced prohibitory orders further weakens the basis for the 39(1)/121(2)/117(e) allegations, since the core act was taking out the deity for prayers. After hearing, the Judge finds the proceedings frivolous and unfounded, and invokes the Bhajan Lal doctrine to quash the proceedings. Consequently, the CRL.MC is allowed and CC No. 579/2015 is quashed. The matter reflects a cautious approach to abuse of process while upholding procedural requirements under Cr.P.C. and IPC/Kerala Police Act provisions.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners argue that the final report/charge sheet is vitiated by improper initiation of a complaint under Section 195 Cr.P.C., since the FIR/complaint was filed by the Sub Inspector rather than the issuing public servant, rendering the 188 IPC charge untenable; there is no production of prohibitory orders to support the 39(1) and 121(2)/117(e) Kerala Police Act allegations; the proceedings are frivolous and without basis, and deserving of quashing under the Bhajan Lal principles.

Contentions of Respondents

The respondents contend that the accused violated an HC order and engaged in temple-related acts warranting several offences under IPC and the Kerala Police Act; they maintain the FIR/final report is properly triggered by the acts alleged and that the section 195 Cr.P.C. issue does not bar proceedings in all respects, though the court ultimately finds the lack of proper initiation critical.

No.579 of 2015 on the files of Judicial First Class Magistrate Court-II, Neyyatinkara. arising out of Crime No.158 of 2015 of Poovar Police Station. Petitioners have challenged the final report filed in the above case in this proceeding under Section 482 of Cr.P.C. 2. According to the prosecution, on 22.02.2015, the accused had, in violation of an order of the High Court of Kerala and also contrary to the direction of the District Collector, took out the diety from the Irupaikonam Sree Bhagavathi Temple and carried out prayers in connection with the temple festival and thereby committed the offences under Sections 143, 147, 149, 188, and 109 IPC apart from Section 39 r/w Section 121(2) and 117(e) of the Kerala Police Act, 2011. 3. I have heard Sri. V. S. Babu Gireesan, learned counsel for the petitioner as well as Sri. Noushad K. A., learned public prosecutor. CRL.MC NO. 4947 OF 2024 7 **==> picture [57 x 57] intentionally omitted <==** ``` 2024:KER:59645 ``` 4. Though the prosecution alleged that the accused had defied an order issued by the High Court of Kerala and committed the offence under Section 188 IPC, the FIR was registered at the behest of the Sub Inspector of Police. Section 195 (1)(a)(i) Cr.P.C requires that a complaint alleging offence punishable under Section 188 IPC will have to be initiated by the public servant who issued the order or by a person who is administratively subordinate. It is evident that the complaint having been initiated by the Sub Inspector of Police is contrary to Section 195 of Cr.P.C and therefore Section 188 IPC has no application. 5. The said proposition also applies with equal vigour to the alleged commission of offence under Section 188 IPC as against the order of the District Collector as well. The complaint having not been filed by the public servant or by a person who is administratively subordinate, cognizance could not have been taken for offence under Section 188 IPC. Therefore under no circumstances can petitioners be prosecuted for the offence under Section 188 IPC. 6. Further, none of the alleged prohibitory orders have been produced by the prosecution along with the final report. In the absence of such prohibitory orders, the allegation regarding CRL.MC NO. 4947 OF 2024 8 **==> picture [57 x 57] intentionally omitted <==** ``` 2024:KER:59645 ``` commission of offence under Section 39(1) and 121(2) apart from 117(e) of the Kerala Police Act, 2011 also cannot be attracted since the allegation in the final report only indicates that the diety of the temple was taken out for conducting religious prayers. 7. On a perusal of the final report, I am satisfied that the proceedings have been initiated against the petitioners, frivolously and without any basis. Accordingly, I am satisfied that the principles laid down in the decision in **State of Haryana and Others v. Bhajan Lal and Others, (1992) Supp.(1) SCC 335)** can be invoked to quash the proceedings. 8. Accordingly, the proceeding in C.C.No.579/2015 on the files of Judicial First Class Magistrate Court-II, Neyyatinkara, arising out of Crime No.158 of 2015 of Poovar Police Station is hereby quashed. Hence, this Crl.M.C is allowed. **Sd** /- **BECHU KURIAN THOMAS JUDGE** HKH/31.07.2024 CRL.MC NO. 4947 OF 2024 9 **==> picture [57 x 57] intentionally omitted <==** ``` 2024:KER:59645 ``` ## **`APPENDIX OF CRL.MC 4947/2024`** ``` PETITIONER ANNEXURES ANNEXURE 1 ``` ``` TRUE COPY OF THE CHARGE IN C.C.NO.579 OF 2015 OF THE JUDICIAL FIRST CLASS MAGISTRATE COURT-1, NEYYATTINKARA ```
