## O R D E R
The subject matter in Crl.M.C. and W.P. (C) being similar, both are considered together and this common order is passed.
2. Crl.M.C. No. 132 of 2022 is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C.’) seeking to quash the Final Report filed by the investigating officer in SC No.432/2021 on 21.12.2020, on receipt of which on its file, SC No.432/2021 was registered by Court of Sessions, Pathanamthitta.
3. The above Writ Petition was filed under Article 226 of the Constitution of India seeking to call for the entire records pertaining to Exts.P15 and P16 from respondents 2 to 5 by issuing a writ of mandamus or any other appropriate writ, order or direction.
4. The petitioners in the Crl.M.C are Indian Youth Congress (for brevity as IYC) activists and arrayed as accused in Crime No.1757/2020 of Thiruvalla Police Station, Pathanamthitta District.
Crl.M.C. No. 132 of 2022 and W.P.(C) No. 22596 of 2020
-:5:-
They were alleged as committed offences punishable under Sections 143, 149, 323 and 294(b) of Indian Penal Code (for short ‘IPC’) and Section 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short ‘SC/ST(POA) Act’).
5. It is averred in the Writ Petition that the petitioner is an IYC activist and was arrayed as 5[th] accused in Crime No.1757/2020 of Thiruvalla Police Station, Pathanamthitta District. He is alleged to have committed offences punishable under Sections 143, 149, 323 and 294(b) IPC and Section 3(1)(s) of the SC/ST(POA) Act. True copy of the FIR and FIS in Crime No.1757/2020 are produced alongwith the petition on hand as Ext.P1. The allegation was that the petitioner hurled abusive language at the defacto complainant. It is averred that the alleged incident was a fabricated one by the Leader of Opposition in Kerala Legislative Assembly, Sri.Ramesh Chennithala and his nefarious plan was carried out by the Kerala Pradesh Congress Committee (for short ‘KPCC’) Vice President Sri.Joseph Vazhakkan and General Secretary Sri.Jyothikumar Chamakkala.
6. The 1[st] accused in Crime No.1757/2020 was elected as the IYC Assembly President, Thiruvalla Assembly, Pathanamthitta. True copy of the Election result 2020 is produced alongwith the petition on

hand as Ext.P2. The IYC District Committee, Pathanamthitta had directed all IYC men in the District to conduct protest named “Prathishedha Three Phase” on 08.05.2020 against K.S.E.B for nonintroduction of various social welfare measures during Covid-19 pandemic. True copy of the Facebook poster issued by the IYC, Pathanamthitta is produced alongwith the petition on hand as Ext.P3. On 08.05.2020 IYC Thiruvalla activists started a peaceful protest at 10.45 a.m. before the K.S.E.B office, Thiruvalla, photograph of which is produced alongwith the petition on hand as Ext.P4.
7. As per the allegation, the defacto complainant alongwith a group of anti-socials barged into a peaceful protest and attacked the IYC activists, Thiruvalla. In the incident, the defacto complainant lost his balance and slipped down. The petitioner was nowhere in the place and did not participate in the incident, but unfortunately he was made as 5[th] accused. The petitioner is doing his Ph.D in Food Science on “Standardisation and Development of value added product from Baccaurea Courtallensis (Wight) Against Hyperlipidemia” at the Department of Food Science and Technology, KUFOS, Kochi. He has allegedly hurled abusive words at the defacto complainant. Since he was falsely implicated into the crime, he has filed a petition before

the Deputy Superintendent of Police, Thiruvalla against the defacto complainant and his anti-social associates who attacked the petitioners. Receipt, evidencing filing of petition, issued from the Office of the Deputy Superintendent of Police is appended to the petition on hand as Ext.P5. True copies of the O.P. Tickets with reference to 2[nd] and 6[th] accused issued from Taluk Hospital, Thiruvalla is produced alongwith the petition on hand as Exts.P6 and P7. The 2[nd] accused e-mailed a petition against the defacto complainant and his anti-social associates on 15.05.2020 at 2.53 p.m. from his e-mail address to SHO of Thiruvalla Police Station, true copy of which is produced alongwith the petition on hand as Ext.P8. True copy of the volunteer ID card issued by Tahsildar, Thiruvalla in favour of Jaaz Nalil Pothen is produced alongwith the petition on hand as Ext.P9. Similar ID cards issued in favour of Jekku Jacob, Girish Kumar, Bonny Mathew, Bibin K Mathew and Bijoy P. Geevarghese are produced alongwith the petition on hand as Exts.P10 to P14.
8. Petitioner has addressed the Chief Secretary, Additional Chief Secretary, District Police Chief and the Deputy Superintendent of Police by filing a petition dated 21.09.2020, true copy of which is produced alongwith the petition on hand as Ext.P15. True copy of
Crl.M.C. No. 132 of 2022 and W.P.(C) No. 22596 of 2020

the e-mail details dated 21.09.2020, 6.19 p.m. sent to the Chief Secretary is also produced alongwith the petition on hand as Ext.P16. True copy of the petition dated 24.09.2020 addressed to the DGP and State Police Chief is also produced alongwith the petition on hand as Ext.P17 and copy of e-mail is produced as Ext.P18.
9. The grievance of the petitioner was that Exts.P15 and P16 petitions preferred before responsible officers who are respondents 2 to 5 in the petition on hand were not considered and appropriate directions are not issued by them. Accordingly, relief as above is sought in the writ petition. Exts.P15 and P16 are petition and e-mail communication forwarded by the petitioner to the Chief Secretary, Additional Chief Secretary, District Police Chief and the Deputy Superintendent of Police, Thiruvalla seeking for entrusting the investigation in the case to a higher authority.
10. The allegation against the petitioners in the Crl.M.C are as follows:- They have hurled abusive words and caste stained language against the defacto complainant who belongs to Scheduled Caste. It is contended by the learned counsel that the case registered against the petitioners is a totally fabricated one. According to him the entire video footages of the incident are available with them, which would

show that defacto complainant and the accompanying anti-socials barged into a Dharna held peacefully by IYC activists. In the scuffle that ensued at the spot, the defacto complainant lost his balance and slipped down and a minor injury was caused to him. Petitions have been filed by the 5[th] petitioner before the Chief Secretary to the Government of Kerala, State Police Chief of Kerala State, Additional Chief Secretary of the Department of Home, Kerala and District Police Chief of Pathanamthitta District alongwith entire video footages of the incident in question relating to Crime No.1757/2020 of Thiruvalla Police Station, Pathanamthitta via his e-mail address bonnythottadiyil@gmail.com. According to the learned counsel, though the petitioners have submitted representations before the above authorities, those have not been acted upon and are still pending consideration. Without conducting a fair investigation on the allegations raised in the complaint, a Final Report was filed by the investigating officer on 21.12.2020, which is sought to be quashed in the petition on hand.
11. Sri.Dheerendra Kumar, the learned counsel for the petitioners, has drawn the attention of this Court to the copy of the FIS lodged before the Thiruvalla Police Station to set the law in

motion to contend that the petitioners and the alleged accused were known to each other since long. The alleged accused are persons holding remarkable post in Youth Congress, but, even then were addressed as ‘സാമൂഹികദ്രോഹികള്’. Copy of which is produced alongwith the petition on hand as Annexure A. The FIS reads:

12. The learned counsel has drawn the attention of this Court to the election result of IYC Kerala of the year 2020 and contended that the petitioners are holding identifiable posts on being elected to various posts in IYC. According to him, petitioners holding such posts have been referred to by the defacto complainant as antisocials in the FIS. It is further contended by the learned counsel that there is no allegation in the FIS lodged by the defacto complainant to indicate prima facie that the petitioners have committed an offence
Crl.M.C. No. 132 of 2022 and W.P.(C) No. 22596 of 2020
-:12:-
under Section 3(1)(s) of SC/ST(POA) Act. It is found from the allegations in the FIS that one Mr.Jas Pothen alongwith one Mr.Gireesh have uttered the words extracted hereinbelow :
“ SC , പന്നപപൊലയാടി പൂറിമ മോനേ നിന്നെ ആരാടാജില്ലാവൈസ് പ്രസിഡനറആക്കിയത്”
13. The further allegation of the defacto complainant in the FIS was that Mr.Jas Pothen is a member of Christian Community and Mr.Gireesh of SNDP. It has been stated by the first informant that when the defacto complainant was addressed by his caste name, he was mentally insulted in public view and thereby, was prejudiced.
14. The learned counsel has also drawn the attention of this Court to the Final Report laid by Thiruvalla police on concluding the investigation in Crime No.1757/2020. Copies of the relevant pages of it are incorporated with the petition on hand as Annexures N 1 to 13. According to the learned counsel it is found stated in the FIS by the defacto complainant that some anti-socials under the leadership of Mr.Jas Pothen residing at Manjadi attacked the defacto complainant and his co-activists, when they were conducting Dharna against Kerala State Electricity Board (for short ‘KSEB’) as activists of Youth Congress.
Crl.M.C. No. 132 of 2022 and W.P.(C) No. 22596 of 2020
-:13:-
15. For an offence under Section 3(1)(s) to be attracted, there must be an allegation in the FIS that the defacto complainant was called by the caste name knowingly of the caste of the defacto complainant intending thereby to insult and humiliate him in public view. Admittedly the petitioners belong to higher castes and the defacto complainant belongs to Pulaya community. But, the words allegedly uttered and extracted above did not refer to the caste name ‘Pulaya’.
16. In Binoy v. State of Kerala [ 2001 (1) KLT 125], a learned Single Judge of this Court has held that for sustaining the charge under Section 3(1)(x) there need not be any reference of caste name of the victim. It is held that the charge would be complete once it is alleged and proved that there was intention to humiliate him as a member of SC/ST in a place within public view. This dictum was laid on the basis of Section 3(1)(x) available in SC/ST Act prior to amendment in the year 2016. Section 3(1)(x) was substituted by Section 3(1)(s) by Amendment Act 1 of 2016 and that governs the situations after 2016. Section 3(1)(x) which was there prior to the amendment referred to above reads :
Crl.M.C. No. 132 of 2022 and W.P.(C) No. 22596 of 2020
-:14:-
“xx xx intentionally insults or intimidate with intention to humiliate a member of Scheduled Caste or Scheduled Tribe in any place within public view.”
The dictum in Binoy supra was laid on the basis of Section 3(1) (x) which was there in the Act prior to the amendment brought in by the Amendment Act 1 of 2016. In the case on hand the offence alleged is one under Section 3(1)(s) substituted in the place of Section 3(1)(x) of SC/ST(POA) Act. Therefore, the dictum in Binoy supra cannot be followed as a judicial precedent in the case on hand and therefore, is not relied upon. The argument advanced by the learned counsel for the respondent that the decision squarely applies to the situation on hand is discarded being untenable.
17. Ameer Ali v. State of Kerala [2018 (3) KLT SN 19 (C.No.25)] is a case wherein the offence alleged is under Section 3(1)(s) of SC/ST(POA) Act. It was held in the case by a Single Bench of this Court that when an allegation was raised by the defacto complainant while lodging the FIS that the accused made a reference of her caste name and insulted and abused her, it would prima facie attract ingredients of offences punishable under Sections 3(1) (r) and 3(1) (s) of the Act.
Crl.M.C. No. 132 of 2022 and W.P.(C) No. 22596 of 2020
-:15:-
18. In State of Kerala v. Hassan [2002 (2) KLT 565] relied on by the learned counsel to rest his contentions, it was held that in a prosecution under Section 3(1)(x) of SC/ST(POA) Act it must be established by the defacto complainant that the humiliation was on the ground that the victim is a member of such caste or tribe.
19. The alleged case of the prosecution in the case cited above was that while trying to maintain law and order in front of Rayonpuram Post Office at Perumbavoor, the accused who belongs to a higher caste intentionally insulted PW1 who was the Assistant Sub Inspector of Police, Perumbavur who belongs to SC/ST and thereby the latter was humiliated in public view. The learned Single Judge has observed as above in that context. But it is pertinent to note that the said dictum is laid down on the basis of Section 3(1)(x) which was the provision available in the Act prior to the amendment brought in by Act 1 of 2016. Therefore, the dictum cannot be applied to the case on hand. But the observation of the court in the said case regarding the term 'പുലയനാടി' has relevance in the context and therefore, the same is extracted hereunder :
“9. The term "Pulaya nadi" does not find a mention in the dictionaries. The learned Government Pleader has failed to give its exact meaning. At the same time, the term "Pulayadi" is one of the

-:16:-
terms mentioned in Malayalam English Dictionary by Prof.M.I.Warrier and two others, D.C.Books Edition, 2000, which gives its meaning as 'prostitute'. The Assisi Malayalam- English Dictionary gives the meaning as 'adulterer'. 'Puladimon' hence only indicates adulterer or son of a prostitute. It has no caste implication. This is precisely why PW1 admitted in cross examination that it is used as an obscene word in common parlance. It has little connection with the caste 'Pulaya' especially when it is possible to infer from the admission of PW1 that there was no need why PW1 should address him with his caste name when there was actually no clash between persons of upper and lower castes or between PW1 and the members of Citizen's Forum or for that matter even between the police force and the Citizen's Forum.
Absolutely no motive is given by PW1 as to why he should be insulted by a stranger like the accused with reference to his caste name. The proved circumstances are such that the accused, even if he had used the particular term, had used it as an obscene word and not with reference to the caste of PW1.”
20. In the case on hand the defacto complainant was not addressed or called by his caste name pulaya by the accused. The word uttered was specifically mentioned in the FIS lodged by the defacto complainant as ‘Pulayadi’. For the word ‘Pulayadi’ was made a mention note in Malayalam-English Dictionary by Prof. M.I. Warrier and Others, DC Books 2000 Edition and the meaning given is ‘prostitute’. In Assissi Malayalam-English Dictionary also a meaning assigned to the word is ‘adulterer”. Therefore, the word ‘pulladimon’

can be assigned the meaning either as an adulterer or as son of a prostitute and that, to any stretch of imagination can be taken to have a caste implication.
21. As rightly pointed out by the learned counsel for the petitioner the word allegedly uttered by the petitioner in the case on hand was ‘pulayadimon’. As per the discussion of the learned Single Judge in Hassan supra the word ‘pulayadimon’ has no caste implication. Therefore the allegation of the defacto complainant that he was insulted and humiliated by the petitioners in public view by calling his caste name is totally devoid of any legal basis and his allegation that an offence under Section 3(1)(s) has been committed by petitioners cannot be said to have any legal force.
22. It is found from the Final Report, copy of which is made available that the major number of witnesses cited by the prosecution are friends and companions of the defacto complainant. All of them belong to the same political party and are activists of it. The statement recorded from them under Section 161 Cr.P.C and incorporated in the Final Report are stereo type ones. The words uttered by all of them are the same. As per the averments of the defacto complainant itself, Police were present at the spot at the time

of the incident itself. Two of such policemen, who allegedly have seen the incident, were made witnesses by the prosecution in the Final Report laid in the case on hand, as CWs 6 and 7. The statements of the witnesses recorded under Section 161 Cr.P.C were also made available by the petitioners as Annexures N18 and N19. Respective statements of CWs 6 and 7 are relevant and are extracted hereunder:

7 were also people admittedly available at the spot during the currency of the incident. They being not part of either groups allegedly involved in the controversy can be taken as people having independent assessment of the incident. Their presence at the sport at the relevant time was admitted by the defacto complainant in his FIS itself. CWs 5 and 6 have categorically stated that they have not heard anyone calling the caste name of the defacto complainant. It has also been stated by them that a scuffle was ensued and both the defacto complainant and the petitioners sustained injuries. Therefore, the contentions raised by the learned counsel for the petitioners appear to have basis. Evenif the trial is proceeded with the materials available and proposed by the prosecution for reliance, it would only culminate in failure. Crl.M.C is only to be allowed for the reasons.
In the result, Crl.M.C No.132 of 2022 stands allowed. The Final Report laid against the petitioners and SC No.432/2021 registered on its basis on the files of Court of Sessions, Pathanamthitta stand quashed forthwith as against the petitioners. Since Crl.M.C was allowed and Crime No.1757/2020 registered against the writ petitioner and other accused was quashed as above, W.P.(C)
