## _Raman, J._
Petitioner, while working as Deputy Devaswom Commissioner (Inspection) in the Head Office of the Travancore Devaswom Board at Thiruvananthapuram, was transferred and posted as Deputy Devaswom Commissioner for Thiruvabharanam at Aramula, by Ext.P3 order passed by the Travancore Devaswom Board, which is challenged in this writ petition as arbitrary and actuated by malafides and not in the interest of the administration or exigency. By Ext. P3 order, a post of Deputy Devaswom Commissioner for Thiruvabharanam, at Aranmula, was restored by the Board, cancelling its earlier decision of shifting the Office of Deputy Devaswom Commissioner for Thiruvabharanam from Aranmula to Thiruvananthapuram. By the same proceedings Ext.P3, another officer Sri. K. Balagangadharan, who was the Acting Deputy Devaswom Commissioner (Audit) in the Internal Audit Wing was transferred and posted as Acting Deputy Devaswom Commissioner (Inspection) vice the petitioner

:2:
transferred. Petitioner was holding the post of Deputy Devaswom Commissioner (Inspection) only since 23.7. 2007 and this transfer was effected hardly within a year of such posting. According to the petitioner, since the normal tenure is three years, he is eligible to continue in the same post for two more years and this was ignored while effecting the transfer. Further, he has only two years to retire from service on superannuation and as per the approved guidelines an employee having only two years to retire shall not be transferred out of his home town and he being a resident of Poojappura at Thiruvananthapuram, the present transfer is against the approved guidelines in the matter of transfer also. The post of Thiruvabharanam Commissioner is taken as equivalent to the cadre of the Devaswom Commissioner. That post was upgraded considering the importance of the said post.
2. Petitioner has produced the relevant page of the report of the High Power Commission. According to the High Power Commission, Thiruvabharanam (temple jewellery and gold), which are very valuable, have not been inspected properly for decades together though there is a special officer for Thiruvabharanam. According to the Commission, the evidence taken points out the poor and unsatisfactory way in which the function is discharged by the then incumbent. Hence, it recommended

shifting of the Office of the Thiruvabharanam Commissioner to the headquarters of the Board, at Thiruvananthapuram, which was accepted by the Board and it is while implementing the recommendations contained in Ext.P1 that the Office of Thiruvabharanam Commissioner was shifted to Thiruvananthapuram. But according to the petitioner, the post of Finance and Accounts Officer was upgraded to the post of Devaswom Commissioner and down graded the post of Thiruvabharanam Commissioner to that of Deputy Devaswom Commissioner, as is evident from Ext.P2 dated 8.2.2008. While so, petitioner, who was working as Deputy Devaswom Commissioner (Inspection), was transferred to Aranmula as Deputy Devaswom Commissioner (Thiruvabharanam) as stated earlier. He submits that Ext.P3 is vitiated since the act of down grading the post of Thiruvabharanam Commissioner to the post of Deputy Devaswom Commissioner is a clear violation of the earlier order of this Court permitting upgradation of the post of Thiruvabharanam Commissioner as that of Devaswom Commissioner and that his transfer to Aranmula as per the impugned order is against the approved transfer guidelines and against the recommendations of the Devaswom Commissioner. According to him, one of the members of the Board himself has sought to review his transfer. Besides, such a request was made by the
_**WP(C) 24742/2008**_
:4:
Devaswom Commissioner also. A copy of the guidelines or norms for transfer is produced by the petitioner as Ext.P4. Reference is made to Clause 15 thereof and contends that under no circumstances an employee like the petitioner having only less than two years to retire shall be transferred out of his home town. It is his case that the Board has accepted that Clause 15 in Ext.P4 will apply even in the matter of transfer of Mel Sathi of Aranmula Devaswom, as is seen from Ext.P5 order dated 28.6.2008. Ext.P6 produced is a note submitted by Sri. Narayanan, a Member, to the Board requesting to review the petitioner's transfer. Ext.P7 is a recommendation made by the Devaswom Commissioner in this regard. According to the petitioner, after passing the order Ext.P3, when there was a forceful attempt to assume charge of the post which the petitioner holds, the Devaswom Commissioner issued an office order not to relieve the petitioner and further directed not to hand over charge to anybody. A true copy of the said order is produced as Ext.P8 in this writ petition. It is also stated that the petitioner's wife is suffering from Parkinson's disease and the petitioner's constant service is required for her daily needs. According to the petitioner, his service was required by the Devaswom Commissioner and found indispensable at the Commissionerate Office; but the recent drift and difference of opinion between the Board and the Devaswom
_**WP(C) 24742/2008**_
:5:
Commissioner has culminated in transferring the petitioner from his office so as to inactivate the Devaswom Commissioner and to make his appointment feeble and inept.
3. In the counter affidavit filed by the Secretary of the Devaswom Board, the allegations made in the writ petition is denied. It is stated that Ext.P5 proceedings of the Board in the case of a Melshanti was challenged before this Court and this Court set aside the said order and directed the Board to reconsider the issue after hearing the petitioner therein and in such circumstances, Ext.P5 is stated to be of no avail to the petitioner. It is also pointed out that the petitioner was working as Deputy Devaswom Commissioner (Inspection) from 23.7.2007. So however, he was working in different posts within the Thiruvananthapuram group or its vicinity. The details of the posting of the petitioner from 30.11.1990 till passing of Ext.P3 order are also given in para 5 of the counter affidavit. It is the further case of the Respondent Board that Ext.P4 guideline is issued only with respect of the temple employees and the petitioner being a senior Gazetted Officer in the rank of Deputy Devaswom Commissioner, he cannot contend that the said guidelines would be applicable to him. Even assuming without admitting that such guidelines are applicable, the Board is entitled to deviate from such guidelines and an order similar to Ext.P3
_**WP(C) 24742/2008**_
:6:
could be issued, if need arises. It is also admitted that a post of Special Officer was created in the year 1982 for Thiruvabharanam in the rank of Devaswom Commissioner and later, the said post was renamed as Commissioner for Thiruvabharanam. The then Executive Officer, Sabarimala, who was in the grade of Deputy Devaswom Commissioner was due for promotion to the cadre of Commissioner, finding that his services as Executive Officer, Sabarimala would be more useful, the grade of Executive Officer, Sabarimala was upgraded to the rank of Devaswom Commissioner after downgrading the post of Commissioner for Thiruvabharanam to that of Thiruvabharanam Deputy Commissioner. Again, when Sri. A.C. Godavarma, who was working as Finance and Accounts Officer of the Board was due for promotion, the Board shifted the post of Commissioner for Thiruvabharanam to that of the Finance and Accounts Officer, as Sri. Godavarma had only about five months to retire and as his services as Finance and Accounts Officer was found to be very useful. Hence the Board has issued a proceeding dated 31.1.2008, as per which the post of Finance and Accounts Officer was upgraded to the cadre of Commissioner for Thiruvabharanam and Sri. A.C. Godavarma was allowed to continue in he said post. So however, the consequential order downgrading the post of Commissioner for Thiruvabharanam was not ordered in the order dated
_**WP(C) 24742/2008**_
:7:
31.1.2008 and hence Ext.P2 proceedings was issued downgrading the post of Commissioner for Thiruvabharanam to Deputy Devaswom Commissioner for Thiruvabharanam. Being the appointing authority, the Board has the power to order upgrading or downgrading of a post or shifting of a post and hence there is no illegality or infirmity in Ext.P2 order. It is also submitted that the Board, by its order dated 12.5.2008, ordered to shift the Office of the Deputy Devaswom Commissioner for Thiruvabharanam to Thiruvananthapuram as suggested by the High Power Commission; but when steps were taken to implement the said decision, there was wide spread protest by the general public at Aranmula and hence the local MLA by his letter dated 16.5.2008 requested the Minister for Devaswom to interfere in the matter and to stay the decision of the Board for shifting the Office to Thiruvananthapuram. Subsequently, by order dated 12.8.2008 the said order had been cancelled. The posting of the petitioner as Deputy Devaswom Commissioner for Thiruvabharanam, at Aranmula was considering his capability and ability to perform in the said post as suggested by the High Power Commission. The allegation that the downgrading of the post of the Commissioner for Thiruvabharanam is in gross violation of the orders of this Court is denied. It is stated that Ext.P3 decision was taken by the Board and merely because one of the members of
_**WP(C) 24742/2008**_
:8:
the Board has disagreed with the said decision, it would not entail upon the petitioner to contend that he is not liable to be transferred. It is also stated that once the Board has issued an order, it is not open to the Devaswom Commissioner to have issued a note like Ext.P8 staying the order of the Board and such note issued by the Devaswom Commissioner cannot be acted upon since he is an officer under the Board who is liable to implement the decision of the board rather than staying the same. Though the Devaswom Commissioner had recommended upgradation of the office of the Deputy Devaswom Commissioner for Thiruvabharanam to the rank of Commissioner and the same be shifted to Thiruvananthapuram and one Sri.
Thulaseedharan Thampi be posted as the Commissioner for Thiruvabharanam, as stated earlier, such transfer was cancelled as per proceedings dated 12.8.2008, in view of the public protest with respect to the shifting. Sri. Thampi was due for promotion to the rank of Commissioner and will retire on 28.2.2009 and he was promoted and posted as Finance and Accounts Officer as per order dated 12.8.2008 in the post held by Sri. A.C. Godavarma who retired on 30.6.2008. Subsequent to the passing of Ext.P3 the 4th respondent reported in the Office of the Devaswom Commissioner to assume charge as Deputy Devaswom Commissioner (Inspection). But since the petitioner did not hand over
_**WP(C) 24742/2008**_
:9:
charge to him in view of Ext.P8 order, the 4th respondent made a representation on 12.8.2008 to the Board and the Board, by proceedings dated 13.8.2008, directed the 4th respondent to report before the Deputy Devaswom Commissioner (Admn.) and assume charge forthwith. Ext.R1 (a) is the copy of said proceedings of the Board. Accordingly, the 4th respondent is stated to have assumed charge as evidenced by Ext.R1(b). But Ext.R1(b) is only a form and it does not in any manner show that the he had assumed Office at Aranmula. It is also stated that on 18.8.2008 petitioner was posted as Deputy Devaswom Commissioner, Thiruvananthapuram Group in compliance of the interim order passed by this Court; but the date is wrongly shown as 17.8.2008. Subsequently, a corrected order was also passed. Copies of these orders are produced as Exts.R1(c) and R1(d).
4. In the reply affidavit filed by the petitioner, it is averred that no meeting was convened by the Board and no resolution was passed and only orders are issued as that of the Board's order. The Secretary has suppressed many material facts and passing of such order is ab-initio void and is an overt act to interfere with the administration of justice. The Accounts Officer of the Board has given written remarks stating that the so called assumption of charge was illegal and contrary to the statutory prescription.
_**WP(C) 24742/2008**_
:10:
Ext.P9 is the copy of the said communication dated 21.8.2008, wherein it is pointed out by the Accounts Officer that the charge report is countersigned by the Deputy Devaswom Commissioner (Administration), which has no legal validity as the head of office of the Deputy Devaswom Commissioner (Inspection) is the Devaswom Commissioner and not the Deputy Devaswom Commissioner (Administration) since he is not the superior officer of the Deputy Devaswom Commissioner (Inspection). It is also stated in Ext.P9 that the direction issued by the Board in the proceedings dated 13.8.2008 and the countersignature of the Deputy Devaswom Commissioner (Administration) are against the provisions of the Kerala Financial Code and hence he is not in a position to accept the charge
report countersigned by the Deputy Devaswom Commissioner (Administration). Ext.P9 is signed by the Devaswom Accounts Officer. It is also stated that the procedure prescribed in Article 81(A) of the Kerala Financial Code Volume 1 have to be observed in the matter of assumption of charge. If the charge reports cannot be co-jointly signed by the relieved and the relieving officer due to administrative difficulties, the couter signature of the superior authority should be incorporated in the charge report. In the absence of the counter signature of the Devaswom Commissioner, the charge report is not in accordance with law. Even
_**WP(C) 24742/2008**_
:11:
though, this Court directed, by an interim order, to identify a post for the petitioner at Thiruvananthapuram, the Board did not meet on 15th, 16th and 17th of August, 2008. One of the Board members, as per Ext.P10, has addressed a letter to the President of the Board taking strong exception to the arbitrary action of the Secretary in issuing orders. It is stated that the Secretary has concocted the document as though the Board has met on 17.8.2008 and resolved to pass an order transferring and posting the petitioner as Deputy Devaswom Commissioner, Thiruvananthapuram. On 18.8.2008, the Secretary has issued another order correcting the date and the copies of those orders are produced as Exts.P11 and P12 along with the reply affidavit. It is stated that as per the Bye-law, the relevant extract of which is produced as Ext.P13, for regulating the conduct of business at meetings of the Devaswom Board the transfer of officers of the rank of superintendents and above are Board papers and their disposal has to be done by the Board. The averment made in the counter affidavit that the petitioner was in the vicinity of Thiruvananthapuram group is denied and it is stated that he was outside Thiruvananthapuram and had held all responsible onerous positions without giving room for any complaint or allegation. It is reiterated that the transfer norms will apply to all employees. Further, it is pointed out that to favour an employee, the Board
_**WP(C) 24742/2008**_
:12:
used to upgrade post and used to down grade post so as to harass person happened to be persona non grata, which an arbitrary act according to the whims and fancies of the Board. It is stated that the post of Thiruvabharanam Commissioner is to be treated as equal to Devaswom Commissioner and the action of down grading the post and shifting it to Aranmula is done to transfer out the petitioner from Thiruvananthapuram, on a wrong notion that it is the petitioner lending support to the Devaswom Commissioner in his strong nature of functioning. The allegation that he has refused to hand over charge is also denied. He has placed reliance on the fact that the Board has issued orders transferring the petitioner and the 4th respondent on 12.8.2008 and documents have been created as though 4th respondent was relieved in the After Noon of 12.8.2008 itself . On the same day, the 4th respondent made a representation to the Board and on the next day the Board issued orders permitting assumption of charge. According to the petitioner, the undue haste done by the Board as revealed by the above facts is arbitrary. Ext.P15 service details is produced to show that the petitioner's entire service is not at Thiruvananthapuram alone. Ext.P16 is produced to show that the transfer norms is applicable to all types of employees. Ext.P16 is a note made by the President of the Travancore Devaswom Board to the Commissioner of the Board directing

:13:
to ensure the norms and rules are perfectly put to practice in the general transfer and postings of Gazetted and Non-Gazetted Officers under the Board and any violation detected during the scrutiny will be viewed seriously. Copy of this Note is also forwarded to the Secretary of the Board as also to the Superintendent of Police (V & S), Travancore Devaswom Board.
5. The second respondent, in a separate counter affidavit, has justified issuance of Ext.P8 order. According to him, he is the Chief Executive Officer of the Travancore Devaswom Board. He supports the case of the petitioner and according to him, the petitioner was highly knowledgeable of Devaswom matters and a man of impeccable integrity and he was assisting the High Power Commission. According to the second respondent, he has detailed the petitioner as his confidante in arresting the widely acknowledged 'drift' in the Devaswom Administration and found him to be quite useful in that regard. According to him, normally he should have been consulted before the petitioner was transferred. It is also averred that the petitioner is to retire within a period of two years and the accepted norms are against his transfer as it is out of station without any request. There is no complaint or disciplinary measure contemplated against him. Further he has also family problems and his moving out from
_**WP(C) 24742/2008**_
:14:
Thiruvananthapuram in the middle of the year will cause undue hardship to him. It is stated that though no personally not known to him, the 5th respondent is an efficient official and his predecessor has received a vigilance report on the 5th respondent, copy of which is produced as Ext.R2 (A). It is stated that the Secretary of the Board who is only in the cadre of Deputy Devaswom Commissioners is always attempting to over reach all his decisions which are taken in the better interest of the Devaswoms. His predecessor in Office has deposed before the High Power Commission that the post of Devaswom Commissioner has been reduced abysmally to a rubber stamp in the hands of the Board and it is necessary to define the powers of the Board. Many of the powers of the Devaswom Commissioner as the Chief Executive Officer have been slowly ad steadily snatched away by the Board through executive orders and circulars which cannot be done.
6. We have heard the arguments of the learned counsel appearing for the petitioner, the standing counsel for the Devaswom Board as also the learned counsel appearing on behalf of the second respondent.
7. Admittedly, the petitioner was working at Thiruvananthapuram as Deputy Devaswom Commissioner (Inspection), that he was posted in the said post only on 23.7.2007 and has hardly worked for one year in the said post and the normal tenure is for three years in the particular post, that he is
_**WP(C) 24742/2008**_
:15:
a resident of Poojappura, Thiruvananthapuram, that he has only less than two years to retire on superannuation, that he has got some serious family problems, that his wife is ailing and his son is studying in higher secondary class and the transfer is effected during the middle of the academic year after the admission in the school. As per Ext.P4 guidelines, an employee shall not be liable to be transferred from his home town when he has only two years of service left for retirement on superannuation, except on request or when there is a complaint against him. However, there is a dispute as to whether Ext.P4 guideline shall apply in the case of a Gazetted Officer. Though in the counter affidavit, it is averred that Ext.P4 is not applicable in the case of the petitioner, petitioner has produced Ext.P16 along with his reply affidavit which was issued by the President of the Devaswom Board, which spells out that the transfer norms and rules are to be strictly put into practice for the year 2008 and any violation will be viewed seriously. If so, it is rather difficult to accept the contention of the respondent that the transfer norms will not be applicable in the case of Gazetted Officers at least for the year 2008. It is true that deviation from the guidelines is possible, provided it is made in exigencies of administration or for other exceptional reasons. The fact that petitioner was transferred during the middle of the year, that he has only two years to retire and that there are
_**WP(C) 24742/2008**_
:16:
family difficulties also for him to move out from Thiruvananthapuram as recommended by his own superior, the Commissioner in his counter affidavit, amply shows that normally he would not have been transferred except on exigencies of such administration demands. It is not disputed that the petitioner has got an impeccable character and no complaint is made against him regarding his integrity or otherwise. The only reason advanced in the counter affidavit is that as though the respondent wanted to respect the recommendation of the High Power Commission to post a senior officer to the post of Deputy Commissioner, Thiruvabharanam and the petitioner is the best suited for that post. But the petitioner's need and necessity at the Head Office to assist the Commissioner who is the Chief Executive Officer of the Devaswom is not taken into account. Further, admittedly, the Commission has recommended the office of Commissioner, Thiruvabharanam be stationed at Thiruvananthapuram and not at Aranmula. Though the Board had passed an order shifting the Office of the Deputy Commissioner, Thiruvananthapuram to Aranmula, later it was cancelled and simultaneously the petitioner is posted to Aranmula, the reason being that there was a protest from the people. Merely because there was a protest to shift the office, the Board thought not to implement the recommendation of the High Power Commission to have the post shifted
_**WP(C) 24742/2008**_
:17:
to Thiruvananthapuram. In other words, the recommendation made by the High Power Commission is highlighted with a view to justify the transfer without implementing the recommendation fully in all respects. No other reasons are urged for the present transfer and therefore, we are not satisfied that there was any exigencies of administration necessitating the transfer of the petitioner from Thiruvananthapuram to Aranmula, that too after cancelling the earlier order. If only the Commission's recommendations were fully implemented and the petitioner was posted as Deputy Devaswom Commissioner (Thiruvabharanam) at Thiruvananthapuram, then one can find justification in such action. Further, what is the nature of the protest from the public is not mentioned and merely because there is a protest, it should not be accepted if in the interest of administration it is required as recommended by the Commission that the Devaswom Commissioner ( Thiruvabharanam) being a key post be shifted to Thiruvananthapuram, in the interest of the Board and so that Board can exercise control and direct supervision. This is more so because the recommendations are made by the High Power Commission after due consideration of the situation and importance of the post. Further, the Board having accepted the recommendations was not justified in making a somersault and acting against the recommendation. The interest of the administration ought not
_**WP(C) 24742/2008**_
:18:
have been sacrificed to the sentiments of the protesters in Aranmula. If the Commission's recommendation is the reason, normally the Board having shifted the Office to Thiruvananthapuram, should have maintained the same and the petitioner could have been posted there, which was however not done. The manner in which the decision is taken also throws light on the fact that the normal procedure while taking decision on such important matters has been flouted. As per the bye-laws for regulating the conduct of the business at meetings of the Devaswom Board, transfer of Officers of the rank of Superintendent and above, constitute "Board papers" and their disposal has to be done by the Board and such "Board Papers" has to be placed by the Secretary in the meeting of the Board as in the case of other "Board papers" (vide clauses 4 & 5). As per Clause 6 of the Bye-law, if the paper is one that cannot afford to wait till the Board meets but at the same time requires reference to the Board the Secretary shall circulate it among the members and obtain a decision. Admittedly, petitioner herein is in the cadre of Deputy Commissioner and is therefore, above the cadre of Superintendent, whose transfer is to be dealt with by the Board in its meeting unless the paper is so important that it cannot await a Board meeting which could be done by circulation among the members and obtain a decision. We perused the records and find that no Board meeting was

held before effecting transfer of the petitioner. A note is put under the caption "promotion and transfer of Deputy Commissioners Regarding". Except this, the rest of the portion is in Malayalam. It reads that there was a recommendation made by the Devaswom Commissioner recommending the Thiruvabharanam Deputy Commissioner Sri. Balachandran Nair to be posted as Executive Officer, Sabarimala. Consequently, the post held by Balachandran Nair, namely, the post of Deputy Devaswom Commissioner, Thiruvabharanam will become vacant to which the Senior most Assistant Devaswom Commissioner Sri. Jayakumar could be promoted. This recommendation was made by the Devaswom Commissioner as early as on 27.3.2008 which was approved. But it is stated that orders be issued only after the Vishu festival in 1183 M.E., which is signed by all the three members including the President. This is pointed out only to show that in the matter of transfers and postings recommendations made by the Commissioner were received and considered by the Board and a decision taken unanimously.
8. Coming to the case of the present transfer, though this also is captioned as "promotions and transfers of Deputy Devaswom Commissioners Reg:", referring to R.O.C. 75/08/Est. dated 27.3.2008 it is stated that in 1982 a Senior Commissioner was appointed as

Thiruvabharanam Commissioner as directed by this Court and that it was taking into consideration the importance of keeping the various valuable jewels and also its inspection, that such a senior officer was posted as Thiruvabharanam Special Officer accepting the recommendations of the High Power Commission. It is also noted that the recommendation of the High Power Commission was accepted by the Board and that the Office of the Thiruvabharanam Commissioner should function at Thiruvananthapuram. At page 39, another note is seen as promotion and transfer of Deputy Devaswom Commissioners Regarding, wherein it points out the recommendation of the High Power Commission to have a post in the cadre of Commissioner, Thiruvabharanam to be functioned at Thiruvananthapuram. The recommendation of the Commission was that the Thiruvabharanam Commissioner should be in the cadre of Devaswom Commissioner. But decision on this matter was deferred for the next meeting of the Board along with other matters and marked as A, B, C & D in the said note. Then starts para 120 with the salutation "Honourable President". It reads as follows:
Hon: President:
The President, TDB has suggested that a senior officer is well versed in Devaswom Rules and Regulations be posted as Thiruvabharanam Dy. Commissioner. This is in par with the

suggestions put forward by Hon: Justice (Rtd) Paripoornan as High Power Commission appointed by the Hon: High Court of Kerala - The incumbent to this post shall necessarily, look after all the suggestions put forward by Hon: Justice (Paripoornan) in this regard." 121. So I suggest that Sri. C.R. Radhakrishnan Nair (Deputy Dev. Commissioner (Inspection)) is transferred and posted as Dy. De. Thiruvabharanam, at Aranmula. This is in view of the public agitation at Aranmula regarding the shifting of Thiruvabharanam Dy. De. Office from Aranmula to Thiruvananthapuram Head Office. So the earlier decision of the Board shifting of Thiruvabharanam Commissioner's Office is hereby cancelled."
9. From the above, it can be seen that the suggestion that Radhakrishnan Nair be transferred and posted at Aranmula is made either by the person who put the notes because the paragraph starts with the sentence "Hon: President". Since it is addressed as "Hon: President", it could be understood as a suggestion made by the Secretary who put the note. Even we take it as a decision taken by the President it still cannot be taken as a Board's decision but only the decision of the President and there was no Board meeting held for the purpose and it was only circulated. Again there are many paragraphs beneath para 120. As against para 128 one member has recorded as "I agree with the Hon: President in this regard". But even that sentence is in the same hand writing. The signature

put thereunder is evidently using a different pen and ink. Again in para 129
another member Sri. P. Narayanan has made a dissenting note as follows:
"1. ട പമഷനകളല സല ററങളല പ.സ.ആര രധകഷ ന നയരര സബനച ഇനയ രയന 2 വരഷ പ* ബകയ ളള ഉമ-.ഗസരനന നലയക -മരക സല ററന ടല.

10. Though this is written in Malayalam, it appears to be in similar hand-writing. Further, though para 120 as referred to above shows that Radhakrishnan Nair is transferred and posted cancelling an earlier decision of the Board shifting the Thiruvabharanam Office to Thiruvananthapuram, nobody has signed under it. In other words, the decision contained in paragraphs 120 to 127 and 128 is the endorsement said to have been made by one member and it is under that, in red ink, the President and another member have signed. No exceptional circumstance is made by pointing out an emergency to take such a decision by circulation and normally, this is a matter to be placed before the Board in a meeting to be held for that

purpose especially when this is a matter pertaining to the cancellation of a previous order passed by the Board and transferring a senior officer in the level of Deputy Commissioner's post. All these are simultaneously done and as already pointed out, even as per the procedure prescribed under the Bye-law it could have been taken only in a Board meeting as no urgency is seen necessitating such a hasty action by circulation. Further, even here, as per the normal rule of practice governing Board meeting when consensus could not be reached among the Board members, the matter requires to be placed in a meeting of the Board. Normally, decisions are taken by circulation only if consensus are reached among the members and not otherwise because the dissenting opinion as expressed by the other member could be brought to the notice of the other members in a meeting giving them an opportunity to deliberate and take a decision. One may agree in the beginning and later if another member disagrees, his view may be considered and it is equally possible when the agreement recorded earlier after deliberation could be changed. That is why when there is a dissenting view expressed, the matter is brought in a Board meeting for consideration and a resolution is adopted. This has not been done in this case.
11. The Existing Organization Chart under Chapter XV shows that the post of Commissioner for Thiruvabharanam is under the direct control

of the Board Secretariat and he is in the cadre of Devaswom Commissioner and is empowered to exercise all the powers and discharge all the duties hitherto exercised and discharged by the Devaswom Commissioner as per the provisions of the Devaswom Manual so far as the valuables are concerned. He will be empowered to discharge the duties mentioned therein and the programmes and works connected with the valuables in Devaswoms. Therefore, it was incumbent on the Board to have continued the post of Thiruvabharanam Commissioner accepting the recommendation of the High Power Commission. At any rate, in a matter of such importance, we do not find there was such an urgency to transfer a person in the background as stated above, that too, by way of circulation of file without holding a Board meeting for the purpose.
12. It may be incidentally pointed out that whenever an officer is promoted, the post he holding itself is upgraded and another corresponding post is down graded as is demonstrated in the counter affidavit. This is a very unhealthy practice. True that the Board is competent to create a post subject to the approval of this court. It can also upgrade a particular post or down grade a post. But it is the necessity of administration that has to be considered while downgrading or upgrading a post and not to suit a particular person or to give him a promotion that a post is upgraded or

downgraded.
13. Now let us consider the subsequent events that have taken place. The manner in which charge was assumed by the 4th respondent is by a Board order. In this connection, Ext.P9 communication of the Devaswom Accounts Officer addressed to the Devaswom Commissioner/Secretary clearly shows that the charge report is counter signed by the Deputy Devaswom Commissioner(Administration) who is not the superior officer of the Deputy Devaswom Commissioner (Inspection). It is stated that the Devaswom Commissioner is the head of the Office of the Deputy Commissioner (Administration) and therefore, the direction issued by the Board and the countersignature of the Deputy Devaswom Commissioner (Administration) are against the provisions of the Kerala Financial Code. Hence the Accounts Officer has stated that it is not possible to accept the charge report countersigned by the Deputy Devaswom Commissioner (Administration) and act based on the same.
14. In this connection, we may notice that unless and otherwise specified by separate orders or rules, Kerala Civil Services (Classification Control & Appeal) Rules 1960 as amended from time to time will apply in the Travancore Devaswom Board. Therefore, the assumption of Office contrary to the Kerala Financial Code is not in order.

15. For the above reasons, we find that the order Ext.P3 transferring the petitioner from the post he was holding to Aranmula is clearly illegal and vitiated for various reasons as stated above. Hence we quash the same. It is true that this Court shall not in the ordinary course interfere in the matter of transfer as held by the apex court in _**Mohd. Masood Ahmad v. State of U.P.**_ (2007(4) KLT 457), except when it is found that the order is mala fide or that the service rules prohibit such transfer or that the authorities who issued such orders were not competent to pass the same. We have already found that the transfer of the petitioner is in violation of the guidelines prescribed and that in the absence of any exceptional circumstance giving valid reasons, normally one would expect that guidelines are followed at any rate in 2008. The President himself has stated that guidelines for transfer are to be strictly followed; otherwise threaten with dire consequence. In the absence of any exigencies of reasons or such good reasons and in the way in which action is taken, it has to be held that the order passed transferring the petitioner is arbitrary. We have already pointed out that even without holding a Board meeting a decision was taken and the manner in which such decision is arrived at are therefore contrary to the provisions as referred to in the foregoing paragraphs.
16. Before parting with this case, we may however add to say the
_**WP(C) 24742/2008**_

following: The post of a Commissioner is a Chief Executive post. The Commissioner is an officer appointed by the Board and he is a person selected by this Court for such appointment. The post of a Commissioner is a statutory post and it cannot be treated in the manner of other post created by the Board. Chapter XV deals with the duties of the Devaswom Commissioner. He is the Chief Executive Officer of the Department of Devaswoms and Hindu Religious Endowments. He shall also carry out the orders and directions of the Board from time to time. He shall supervise and control of the working of the subordinate officers of the Department. He shall regulate the expenditure within the sanctioned 'pathivus' and estimates. He shall watch and collect the receipts from all sources due to the Devaswom funds and all other institutions under him. He shall see that the live stock attached to the Devaswoms are properly cared for. There are various other general powers conferred on the Devaswom Commissioner enlisted as per the Manual. The Devaswom Department is under the Devaswom Commissioner, subject to the supervision, control and direction of the Board, who shall be appointed by the Board. As per Section 29(3) of the Act, the Devaswom Commissioner is the Chief Executive Officer of the Department of Devaswom and Hindu Religious Endowment.
17. The supervision, direction and control has therefore to be
_**WP(C) 24742/2008**_
:28:
exercised by the Board either as prescribed by Rules or by Board decisions taken in accordance with law.
18. As per Section 13 of the Act, the meeting of the Board is to be presided over by the President or in his absence by a member authorised in this behalf. The quorum for such meeting is two and in case of difference of opinion a decision is taken by majority and if the number is equal, president can exercise a casting vote.
19. In the case of Board Secretariat, Secretary is the chief administrative officer. Thus the Board Secretariat is different from Devaswom Department. The Secretary is the convener of the meeting and prepare agenda for the meeting He is to prepare the minutes of the proceedings of the Board meeting and shall submit the same for approval by the Board at the next meeting and keep in his custody the minutes book.
20. Section 3 of the Travancore-Cochin Hindu Religious Institutions Act provides that the entire administration vests in the Board. Section 4 deals with the constitution of the Travancore Devaswom Board. As per Section 15(2) of the Act, the Board shall exercise all powers of direction, control and supervision over the incorporated and unincorporated Devaswoms and Hindu Religious Endowments under their jurisdiction. As per Section 16 of the said Act, the Board shall, subject to the provisions of

Part 1 of this Act, exercise, supervision and control over the acts and proceedings of all officers and servants of the Board and of the Devaswom Department. Thus it has to be stated that since the Commissioner is under the supervision, control and direction of the Travancore Devaswom Board,
he cannot bye-pass the directions issued by the Board and we cannot approve his action of issuing an order like Ext.P8. Even if the transfer is invalid for any reason whatsoever, the Commissioner could have only requested for re-consideration of the matter; and could not have issued orders not to relieve him from his Office. The Board members and the Commissioner have to work in co-ordination. Various matters of the Travancore Devaswom Board involve huge expenditure, especially in connection with Sabarimala matters, the Devaswom Commissioner has to discharge very high responsibility and whenever required he should seek the advice of the Board. So also he is bound by the directions if any issued by the Board. At the same time, he is next to the Board. We would remind the Board that the Commissioner being the Chief Executive, he has to be given the choice to post officers on whom he has confidence to be retained with him for his effective functioning. The views of the Commissioner and his recommendations on various matters of administration cannot be brushed aside by the Board, that too, in a light

fashion. This, we think, will avoid friction and will pave way for a smooth and effective functioning of the Devaswom Board. We expect that in future, the Board and the Commissioner will work in co-ordination without room for any complaints of their respective functions.
The writ petition is allowed as above.
