Case Synopsis & Summary

The Kerala High Court, in a consolidated order, disposed of five writ petitions challenging the recovery of amounts paid as Extra Duty Allowance to Pump Operators (Higher Grade) at the University of Calicut. Petitioners Arjunan P., James V.U., Mohammed Basheer C., Abdussalam Punnakkandi, and Sahadevan T. had received extra duty allowances in 2002, 2003 and 2008 based on university resolutions. Following audit objections, the University recovered these amounts from pension benefits but subsequently issued Ext. P4 offering refunds, and later, Ext. P5 indicated a fresh audit objection by the State Audit Department. Relying on the Supreme Court’s decision in State of Punjab & others v. Rafiq Masih (White Washer) and this Court’s Ext. P6 (judgment in 2905/2013), the learned Judge held that where payments were not tainted by fraud or misrepresentation, refunds could not be unduly blocked by new audit objections. The court concluded that Ext. P5 should not stall relief already contemplated by Ext. P4 and directed the University to disburse the eligible amounts within one month, and to seek clearance of the later audit objection from the State Audit Department consistent with Rafiq Masih and the court’s 2905/2013 judgment. The petitions were allowed and decided jointly.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners argued that Extra Duty Allowance payments in 2002, 2003 and 2008 were based on valid university resolutions and their recovery was initiated after audit objections. Ext. P4 offered refunds; Ext. P5 indicated a further audit objection. Relying on the Supreme Court’s Rafiq Masih doctrine, they contended that refunds should be granted to low-paid retirees, as the payments were non-fraudulent and the University’s prior resolutions remained valid. They urged the court to direct immediate refund within a fixed timeframe, citing the 2013 judgment (ext. P6) as supporting authority.

Contentions of Respondents

The University argued that the question of error lies with the Audit Department and that action already taken via Ext. P4 cannot be undone without final accountability from the State Audit Department. The Government Pleader contended that the central issue is whether the payments were in error; the University should await the final orders of the audit authority. He suggested relying on Ext. P6 and the 2013 judgment to guide relief, but emphasized awaiting official clearance for any reconciliation with the Audit objections.

Smt.M.Isha – learned counsel for the petitioners, began her submissions saying that the issues - both factual and legal – involved in these cases, have already been noticed and answered by another learned Judge of this Court, through the judgment in W.P.(C) No.2905/2013 - a copy of which is on record as Ext.P6 in all these cases; and that since her clients are identically situated as the petitioners therein, they should be given the same benefits as ordered in it. 3. Smt.M.Isha thereafter explained that her clients were working as Pump Operators (Higher Grade), while they were given certain amounts as “extra duty allowance” in the years 2002, 2003 and 2008, on the basis of valid resolutions of the University; but that a decision was thereafter taken by them, presumably on the basis of certain subsequent audit objections, to recover it. She says that even though the said WP(C) NO. 41770 OF 2022 & CON.CASES. 7 amounts were recovered from the pensionary benefits of her clients, the University understood that such action was wrong and therefore, issued Ext.P4 order, acceding to refund the same to them, also for the reason that the Audit Objections had already been waived by then. She alleged that, however, when her clients approached the University for the amounts involved, they have now been told, through Ext.P5 in all cases, that another Audit Objection has been raised by the State Audit Department and that the explanation of the University is pending their consideration. Smt.M.Isha, therefore, prayed that the University be directed to act as per Ext.P4 in all these cases and to refund the eligible amounts to her clients, within a time frame to be fixed by this Court, particularly because the issue has been squarely covered by the judgment of the Hon'ble Supreme Court in **State of Punjab & others v. Rafiq Masih (White Washer) & others** [(2015) 4 SCC 334], since her clients are all low- paid employees, who have now retired and the benefits sought to be recovered are ones they received more than a decade ago without any allegation of misrepresentation or fraud being attributed to them. She concluded her submissions by saying that, in any event, no such recovery could have been possible, because there was no WP(C) NO. 41770 OF 2022 & CON.CASES. 8 undertaking given by her clients to refund the amounts; and that, even the subsequent judgment of the Hon'ble Supreme Court in **High Court of Punjab and Haryana and Others v. Jagdev Singh** [2016 (3) KLT 2063 (SC)] would, therefore, have no application in the case of the petitioners herein. 4. In response, Sri.P.C.Sasidharan – learned standing counsel for the University, submitted that his client has already taken the decision, as rightly argued by Smt.M.Isha, that the amounts recovered from the petitioners. He submitted that, however, his client is now incapacitated from doing so on account of a subsequent Audit objection raised by the State Audit Department; and prayed that liberty be reserved to them to act as per the final orders of the said Authority. 5. Smt.Parvathy K. - learned Government Pleader, appearing for the official respondents, submitted that the germane question involved in these cases is whether the payments made to the petitioners were in error or otherwise. She pointed out that the Audit Department has found that “Extra Duty Allowance” could not have been paid to the petitioners, while they were working as Pump Operators (Higher Grade) in the services of the University; and WP(C) NO. 41770 OF 2022 & CON.CASES. 9 therefore, that it is up to the said University to answer it appropriately and get it cleared. 6. I must say that the afore stand taken by Smt.Parvathy K. cannot appeal to me fully because, any recovery from the petitioners could have been done only in terms of the ambit of the declarations in **Rafiq Masih** (supra). This does not appear to have been done and presumably therefore, the University acted correctly in issuing Ext.P4, offering to refund the amounts. However, Ext.P5 indicates that the State Audit Department has raised another objection, to which the University has responded and that they are awaiting further orders on the same. 7. That being said, Ext.P5 judgment of a learned Single Judge certainly covers the field because the petitioners herein are undisputedly similarly situated as the petitioners therein. 8. I am, therefore, of the firm view that merely because the State Audit Department has raised an objection subsequent to Ext.P4 proceedings of the University, the petitioners cannot be made to wait ad infinitum, particularly when it is without contest that the benefits obtained by them in the years 2002, 2003 and 2008, were not on account of any fraud or misrepresentation attributed to them, but on the WP(C) NO. 41770 OF 2022 & CON.CASES. 10 strength of valid resolutions of the University, which still remain. 9. Resultantly, I allow these writ petitions and direct the University to act as per Ext.P4 and disburse the eligible amounts to the petitioners within a period of one month from the date of receipt of a copy of this judgment. As far as the objection raised by the State Audit Department is concerned, it will be up to the University to have it cleared based on my observations above and on the strength of the declarations in **Rafiq Masih** (supra), which shall certainly be taken into account and considered appropriately by the said Department, also taking note of Ext.P6 judgment of this Court. **Sd/- DEVAN RAMACHANDRAN** **JUDGE** stu WP(C) NO. 41770 OF 2022 & CON.CASES. 11 ## **APPENDIX OF WP(C) 41773/2022** PETITIONER EXHIBITS Exhibit P1 TRUE COPY OF THE ORDER NO.
