Court Decision / Holding
The six petitions are disposed of: Ext.P6 (WP5592) and Ext.P5 (other petitions) orders are set aside. The 1st respondent (RDO) is directed to reconsider the matter after obtaining a fresh report from the Agricultural Officer, conducting a local investigation, and, if necessary, obtaining a KSRSEC report, at the petitioners’ cost. A final decision must be taken within two months from the copy of the judgment, with a clear opportunity of hearing to the petitioners. The court also clarifies that Ext.P2 (KLU order) should be given due weight if valid, and that verification of Ext.P2’s validity should inform the final decision. The petition is to be disposed accordingly; the court allows the RDO to verify the Ext.P2 order’s validity while passing orders.
Final Disposition
Disposed of the writ petitions; orders under challenge set aside; remand for reconsideration with fresh report, local inquiry, and hearing; final decision to be issued within two months; Ext.P2 to be given weight if valid.

Case Synopsis & Summary

Six writ petitions—WP(C) Nos. 5592/2023, 5752/2023, 6612/2023, 6646/2023, 6679/2023 and 6933/2023—are filed by co-owners of land in Koorkkanchery village, Thrissur District, challenging rejection of Form No.5 applications for exclusion of land from the official data bank created under the Kerala land data regimen. The petitioners allege that their properties were converted under a 1980 Kerala Land Utilisation (KLU) order and included in the data bank despite Ext. P2 (KLU order). They claim the KSRSEC topo data (Ext. P7) shows the land as paddy or fallow/degraded land at various times and that none of the Form 5 parameters were properly considered in Exts. P5/P6, with no hearing offered. Relying on Joy v. Revenue Divisional Officer/Sub-Collector (2021 (1) KLT 433) and Arthasastra Ventures (India) LLP v. State of Kerala (2022 (4) KLT Online 1222), they seek reconsideration under the relevant Act and Rules, arguing the land’s status as of the 2008 Act’s implementation date should drive exclusion. The Court directs a fresh evaluation: an Agricultural Officer report, local investigation, and consideration of Ext. P2 if valid, with a hearing, and a final decision within two months.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contend that Ext.P5 (and Ext.P6 in WP5592) wrongly exclude their lands from the data bank. They rely on Ext.P2 (KLU order, 26-9-1980) to argue pre-existing conversion and status, and contend that the KSRSEC topo data (Ext.P7) shows land use as paddy or falling under old classifications. They submit that none of the Form 5 parameters were adequately considered and that the matter warrants reconsideration under the Kerala Land Tax Act, 1961 and allied Rules, including a fresh LLMC report and a local inquiry, with weight to Ext.P2 if valid, and with opportunity of hearing. They place emphasis on the date of coming into force of the 2008 Act to determine land’s inclusion/exclusion and rely on Joy v. RDO/Sub-Collector and Arthasastra Ventures for guidance, seeking a final decision within two months from the judgment date.

Contentions of Respondents

The respondents defend the challenged orders as proper under Form 5 after due consideration of data bank criteria and LLMC findings. They emphasize adherence to the statutory framework and the need for a thorough, data-driven reassessment if required, while maintaining the integrity of the current data bank. They contend that any reconsideration must be grounded in the Act’s provisions and proper procedure and that the petitioners’ request for fresh reports should be weighed against the need for timely resolution and administrative consistency, under the 2008 Act’s framework.

The order under challenge in WP(C) No.5592 of 2023 is Ext.P6, whereas in all other writ petitions the impugned order under challenge is Ext.P5. 2. The petitioners are the co-owner of various extent of land comprised in Survey No.247/PT-21 of Koorkkanchery Village in Thrissur Taluk. The erstwhile owner has obtained KLU permission from the 1[st] respondent in the year 1980 for conversion of a total extent of 1 Acres and 42 cents of land as per Ext.P2 order and petitioners in the above writ petitions have purchased the property covered by **W.P.(C).Nos.5592,5752,6612, 6646,6679 & 6933 of 2023 14** Ext.P2 KLU order. 3. The case of the petitioners is that their property have been converted in the year 1980 and the same has been wrongly included in the finalized data bank issued by the 4[th] respondent. Thereupon, applications were submitted under Form No.5, which is produced as Ext.P4 in all these writ petitions. Petitioner submits that the KSRSEC report was obtained, which is produced as Ext.P7 in WP(C)5592 of 2023 which shows that as per the toposheet of 1957, the survey plot 247/PT-21 was observed as paddy land. The plot was observed as fallow land with exposed soil in 2007 data and the same land use pattern was continued with vegetation cover in the data of subsequent years as in 2010,2016 and 2021. The petitioner submits that none of the parameters for consideration on the application under Form 5 was considered while issuing the impugned orders. Therefore, they prayed for reconsideration of the ## **W.P.(C).Nos.5592,5752,6612, 6646,6679 & 6933 of 2023 15** matter in accordance with the provisions of the Act and Rules and also taking into consideration the judgment of this Court in _**Joy v. Revenue Divisional**_ _**Officer/Sub Collector, (2021 (1) KLT 433)**_ as well as _**Arthasastra Ventures (India) LLP v. State of**_ _**Kerala, 2022(4) KLT Online 1222**_ . It is the nature of the land as on the date of coming into force of the Act 2008, which is relevant to indicate in exclude a land from the data bank. Therefore, Ext.P6 impugned order produced in WP(C) No.5592 of 2023 and Ext.P5 order produced in other writ petitions are set aside with a direction to the 1[st] respondent to reconsider the matter after obtaining a fresh report from the agricultural officer concerned and after conducting a local investigation and if required after obtaining KSRSEC report at the cost of the petitioner and take a final decision in the matter within a period of two months from the date of receipt of a copy of this judgment. It is **W.P.(C).Nos.5592,5752,6612, 6646,6679 & 6933 of 2023 16** made clear that it is free to the 1[st] respondent to verify the veracity of Ext.P2 while passing orders as directed above and if Ext.P2 order is validly issue, the fact of which the properties are already covered by a KLU order should also be given due weight while deciding the matter as directed above. It is also made clear that the final decision shall be taken after affording an opportunity of being heard to the petitioners. Above writ petitions are disposed of accordingly. sd/- **VIJU ABRAHAM, JUDGE** pm **W.P.(C).Nos.5592,5752,6612, 6646,6679 & 6933 of 2023 17** ## **APPENDIX OF WP(C) 5752/2023** - PETITIONER'S EXHIBITS Exhibit P-1 A TRUE COPY OF THE BASIC TAX RECEIPT DATED 27-8-2021 ISSUED BY 3RD RESPONDENT - Exhibit P-2 A TRUE COPY OF THE KLU ORDER DATED 26-91980 HAVING NO.
