15. In **Rajalekshmi P. v. State of Kerala [2023 (3) KHC 491]** a Division Bench of this Court in which one among us [Anil K. Narendran, J] was a party held that, in view of the provisions of the Travancore-Cochin Hindu Religious Institutions Act, the Travancore Devaswom Board is duty bound to see that the regular traditional rites and ceremonies according to the practice prevalent in Vellayani Bhadrakali Devi Temple are performed promptly and arrange for the conduct of the daily worship and ceremonies and of the festivals in Vellayani Bhadrakali Devi Temple according to the usage. The Temple Advisory Committee of the said temple, which consists of devotees who fall under the eligibility criteria prescribed in Clause (3) of the Rules framed under sub-section (3) of Section 31A of the Act, is duty bound to render necessary assistance to the Board and its officials for the smooth functioning of the temple activities and festivals according to the usage. In that view of the matter, the petitioner cannot invoke the writ
13
W.P.(C)No.25175 of 2023
jurisdiction of this Court under Article 226 of the Constitution of India, seeking a writ of mandamus commanding the Travancore Devaswom Board and its officials to include Kuzhithalachal and Kalluvila wards in Vellayani in the list for Kalliyoor Dikkubali in Vellayani Sree Bhadrakali Temple, in violation of the accepted boundary limit followed from time immemorial.
16. Clause (18) of the Rules prohibits the Temple Advisory Committee from collecting funds in connection with any ceremonies in the temple by placing kanikkavanchi or hundials. When coupons are printed for development activities in the temple, with the approval of the Department, only coupons for
the specified amount shall be printed. No receipts without the seal of the Assistant Commissioner shall be used for collecting funds.
17. In **Sunil Kumar C. and others v. Travancore Devaswom Board and others [2022 (4) KHC 663]** a Division
Bench of this Court in which one among us [Anil K. Narendran, J.] was a party noticed that the provisions under Clause (18) of the Rules provide for sufficient safeguards to prevent the illegal collection of funds by the Temple Advisory Committee.
18. In the instant case, by Ext.P7 order dated 31.03.2023 of the 2[nd] respondent Devaswom Commissioner, which is under
14
W.P.(C)No.25175 of 2023
challenge in this writ petition, the Temple Advisory Committee of Sree Chali Narayanapuram Maha Kshetram stands dissolved for the reasons stated therein. The misconducts alleged against the Temple Advisory Committee are grave in nature. As per Clause (12) of the Rules, the Devaswom Commissioner have the power to remove the members of the Temple Advisory Committee on the basis of specific reasons. In the event of the activities of the Temple Advisory Committee being contrary to the interest of the temple, Hindu faith or the Devaswom Board, or in the event of specific financial irregularities, the Devaswom Commissioner have the absolute power to remove the Temple Advisory Committee.
19. On a query made by this Court, the learned Standing Counsel for Travancore Devaswom Board would submit that before acting on report No.554 dated 15.03.2023 of the 3[rd] respondent Assistant Devaswom Commissioner (Ref. No.3 in Ext.P7 order dated 31.03.2023), the Temple Advisory Committee was not issued with notice to offer their explanation. If that be so, Ext.P7 order is one issued in violation of the principles of natural justice and on that sole ground, the same is liable to be interfered with.
20. In this writ petition, one of the grievances of the
15
W.P.(C)No.25175 of 2023
petitioner is that, after the issuance of Ext.P7 order, steps are being taken to constitute a new Temple Advisory Committee for Sree Chali Narayanapuram Maha Kshethram, during the pendency of Ext.P8 appeal filed before the 1[st] respondent Board.
21. The learned Standing Counsel for Travancore Devaswom Board, on instructions, would submit that after Ext.P7 order dated 31.03.2023 of the 2[nd] respondent Devaswom Commissioner, the entire activities in the temple are managed by the 4[th] respondent Sub Group Officer.
22. In the above circumstances, this writ petition is disposed of by treating Ext.P7 order dated 31.03.2023 of the 2[nd] respondent Devaswom Commissioner as a show cause notice to the Temple Advisory Committee to offer their explanation on the action proposed under Clause (12) of the Rules to remove the Committee for the reasons stated therein, since the said order is one issued in violation of the principles of natural justice, without serving a copy of report No.554 dated 15.03.2023 of the 3[rd] respondent Assistant Devaswom Commissioner (Ref. No.3 in Ext.P7 order dated 31.03.2023). The 2[nd] respondent is directed to reconsider the matter, after serving the petitioner a copy of report No.554 dated 15.03.2023 of the 3[rd] respondent Assistant Devaswom Commissioner (Ref.No.3 in Ext.P7 order dated
16
W.P.(C)No.25175 of 2023
31.03.2023), which shall be served within a period of two weeks from the date of receipt of a certified copy of this judgment. Thereafter, the petitioner shall submit the explanation of the Committee before the 2[nd] respondent, within a further period of three weeks. After considering the said explanation, the 2[nd] respondent shall take an appropriate decision in the matter, after affording the petitioner and other members of the Committee an opportunity of being heard, and after taking note of the legal and factual contentions raised before him and the law laid down in the decisions on the point, as expeditiously as possible, at any rate, within a further period of one month.
The decision, if any, taken by the Travancore Devaswom Board to reconstitute the Temple Advisory Committee of Sree Chali Narayanapuram Maha Kshethram shall be kept in abeyance till such time and the entire activities in the temple shall continue to be managed directly by the 4[th] respondent Sub Group Officer.
