Case Synopsis & Summary
This writ petition challenges Ext.P13, an order of the Malabar Devaswom Board denying inclusion of the petitioner’s name in the temple’s schedule of establishment and holding the appointment as Vazhipadu Clerk to be irregular. The petitioner, appointed on 1.9.2009 as a temporary Clerk in Sree Amakkavu Bhagavathi Devaswom due to urgent need, sought regularization and inclusion in the establishment schedule. Following Ext.P5 sanction of a post, Ext.P7 issued an appointment order and Ext.P8 was sent to the 3rd respondent for inclusion. On 10.10.2011 the 3rd respondent informed that the appointment violated a circular dated 15.10.2010 (J-8-7347/2010 MDB). Ext.P11 was the Trustee Board’s explanation, arguing urgency and eligibility, but Ext.P13 (9.1.2017) refused approval on the grounds of non-compliance with the circular. The petitioner argued that the circular was not in force at the time of appointment and has been struck down by a Division Bench in a 2016 decision (Malabar Devaswom Hereditary Trustees Welfare Association v State of Kerala, 2016 KHC 4501). The 4th respondent supported appointment, asserting that the HR & CE Act does not mandate blanket prior sanction. The High Court held that since the circular has been struck down, Ext.P13 cannot stand and ordered inclusion from 11.8.2011 with consequential benefits within three months. The writ petition is thus allowed.

Contentions of Appellants / Petitioners
The petitioner submits that his appointment as Vazhipadu Clerk in 2009 was an urgent, temporary measure later regularized against a sanctioned post, with due notice and a call for eligible candidates. Ext.P13, dated 9.1.2017, wrongly rejects the appointment as irregular, relying on a circular (15.10.2010) which is alleged to be not in force at the relevant time and has been struck down by a 2016 decision in Malabar Devaswom Hereditary Trustees Welfare Association v State of Kerala. The petitioner contends there is no statutory requirement for prior board sanction for appointments, and the Board’s attempts to withhold regularization on account of that circular are ultra vires and inconsistent with due process.
Contentions of Respondents
The respondents maintain that the Trustee Board, as appointing authority, must follow due process and compliance with the circular; Ext.P13 denied approval on grounds of non-compliance with the 15.10.2010 circular. They assert that the HR&CE Act and Rules govern such appointments and that prior sanctions may be necessary. The respondents argue that the circular guided the appointment process, and its non-compliance justifies rejection, until corrected by formal sanction.

| Case Name | Citation | Treatment | Explanation |
|---|---|---|---|
| Malabar Devaswom Hereditary Trustees Welfare Association v. State of Kerala and others | 2016 KHC 4501 | Positive | This decision held the circular dated 15.10.2010 to be struck down. The present court relies on that ruling to conclude Ext.P13 cannot be sustained on the basis of the circular, thereby supporting inclusion of the petitioner. |
