Case Synopsis & Summary
C. Mukundan, a former employee of the 5th respondent Thalassery Co-operative Town Bank Ltd., faced disciplinary action prompting his reversion from Internal Auditor/Accountant to Senior Clerk in 1984. An Administrator later took charge of the Society and, interpreting the punishment as six months due to the absence of a fixed period, promoted him after six months (Ext.P4). When the elected committee resumed control, Ext.P5 rescinded the promotion. ARC proceedings were filed (ARC No.9/1992). The arbitrator allowed the ARC, holding Ext.P4 valid and Ext.P5 invalid. The Tribunal, however, reversed in Ext.P10, holding no ARC lay under Section 69 of the Kerala Co-operative Societies Act for service matters. The petitioner challenged Ext.P10 by writ, contending that Ext.P4 was legally permissible and that the disciplinary proceedings were illegal and malafide. The court examined the law as it stood pre-amendment (Section 69 and the definition of business under Section 2(i)) and post-amendment (2 January 2003) which extended Section 69 to disputes involving certain employment matters including promotion, suggesting possible ARC jurisdiction. Ultimately, Ext.P10 was quashed and the Tribunal directed to decide the matter on merits as if ARC could lie under amended Section 69, with a fresh order to be issued within three months.

Submissions & Arguments
Contentions of Appellants / Petitioners
The petitioner sought to quash Ext.P10 and uphold Ext.P4 as a legal promotion within the Administrator’s powers, and to declare the disciplinary proceedings illegal and mala fide. He argued that the ARC had become maintainable under Section 69 and that the promotion/disciplinary disputes were within the scope of employment matters and should be decided accordingly.
Contentions of Respondents
The respondents contended that the matter involves disciplinary proceedings and that ARC under Section 69 was not applicable; after amendment (2.1.2003), promotion-related disputes could fall within Section 69, but the Tribunal’s earlier decision (Ext.P10) was consistent with the law as it stood at that time.

|---|---|---|---|
| Trivandrum Co-operative Urban Bank v. Joint Registrar of Co-operative Societies | 2001(1) KLT 99 | Positive | The court applied this decision to hold that disputes concerning disciplinary proceedings (and by extension promotion) do not fall within the ambit of Section 69 of the Act as then interpreted, guiding its reasoning on the maintainability of ARC and the need to evaluate the matter under amended Section 69. |
