Case Synopsis & Summary
Petitioner C. H. Hamza, owner of vehicle KL-13/C 5301, challenges detention of his vehicle on the allegation of transporting river sand in contravention of the Kerala Protection of River Banks and Regulation of Removal of Sand Rules, 2002. He asserts efforts to secure release from the respondents have been ineffective. The petition notes that under Ordinance No. 60/2012, adjudication powers are delegated to the Revenue Divisional Officer, with the District Collector functioning as the revisional authority. The Government Pleader confirms this delegation. The writ petition relies on the Full Bench decision in Shan C.T. v. State of Kerala (2010) 3 KHC 333 (and 2010 KL T 413), which lays down the framework for interim custody pending confiscation proceedings. Paragraphs 12-13 of that judgment authorize interim custody subject to deposit of 30% of the vehicle’s value, plus a bank guarantee or immovable security for the balance, with the deposit and security to follow the final outcome of proceedings, and to complete proceedings under S.23 within six weeks, with notice to the owner within three days of seizure. The High Court directs the first respondent to consider the interim custody application in accordance with the Shan C.T. principles within one week of receiving a copy of this judgment, and to dispose of the matter within six weeks. The writ petition is disposed of with these directions.

Submissions & Arguments
Contentions of Appellants / Petitioners
The petitioner contends that the vehicle was detained without timely action and seeks interim custody or release in terms of the Shan C.T. decision. He argues that the Act and the accompanying Ordinance empower a prompt and provisional release framework subject to safeguards (30% deposit, security for the balance, and expeditious disposal of proceedings). The petition relies on the Full Bench guidance to secure interim custody pending final orders.
Contentions of Respondents
The respondents submit that Ordinance No. 60/2012 delegates adjudication to the Revenue Divisional Officer with the District Collector as revisional authority, and that the statutory framework governs detention and disposal of such applications. They emphasize adherence to the statutory process and the need to follow the Shan C.T. framework only to the extent consistent with the prima facie framework and time-bound disposal requirements.
