Case Synopsis & Summary

This is a bail application under Section 438 Cr.P.C. by five accused in Crime No. 951/2020 of Hosdurg Police Station, Kasaragod District, alleged to have committed offences under Section 498A IPC. The prosecution case alleges mental and physical harassment of the de facto complainant by the first petitioner, who is her husband, with the remaining petitioners being in-laws. The petitioners contend that the allegations relate to matrimonial cruelty, but assert that the marital relationship between the first petitioner and the complainant continues and that they are ready to abide by any conditions if bail is granted. Counsel for the petitioners maintains that the allegations are not correct and that the petitioners are prepared to cooperate with the investigation and to comply with lawful directions. The Public Prosecutor opposes bail but indicates that stringent conditions may be imposed if bail is granted. The court reiterates the general principle that bail is the rule and jail the exception, citing Chidambaram P. v. Directorate of Enforcement, and also notes the health concerns of the COVID-19 pandemic, referring to Supreme Court directions in Re: Contagion of COVID19 Virus In Prisons and Kerala High Court Full Bench directions. On balancing the facts, the court grants bail with stringent conditions: appearance before the IO within ten days, bond of Rs.50,000 with two sureties, appearance as required, prohibition on leaving India without court permission, prohibition on committing similar offences, and strict adherence to social distancing guidelines; breach can cancel bail.
