Case Synopsis & Summary
This is a bail application under Section 439 CrPC filed by accused Nos.1 to 4 in Crime No.33 of 2024, registered at Pulikeezhu Police Station, Pathanamthitta, alleging offences under IPC sections 294(b), 341, 323, 324 and 308 r/w 34. The prosecution alleges that on 08.01.2024 at about 9 p.m. at Mahadeva Hotel, the defacto complainant and his wife were assaulted by the petitioners with dangerous weapons, including a granite stone, a helmet and a wooden stick; the second accused allegedly struck with a helmet, the third with a wooden stick, and the first with a granite stone, while the assault extended to the complainant’s wife and his brothers, with an attempt to kill them. The petitioners were arrested on 09.01.2024 and have remained in judicial custody since. They submit that they are innocent, have cooperated with the investigation, and that continued detention is unnecessary since investigation has progressed substantially and the final report is likely soon. The Public Prosecutor counters that the investigation is progressing and will soon be ready to file a final report. The court agrees that detention is no longer necessary and, in the interest of justice, grants bail on stringent conditions, including bond, appearance on Fridays, travel restrictions within the local area, protection of victims and witnesses, passport surrender, and a power to cancel bail for violation.
