Case Synopsis & Summary

This is a bail application (Section 438, CrPC) before the Kerala High Court concerning accused Nos. 2 and 3 in O.R. No.1/2020 of Silent Valley National Park Range, Mannarkkad, Palakkad District. The petitioners, Babu and Basheer, were arraigned on charges under the Wildlife Protection Act, 1972, including sections 2(15,16,21,22,24A,35,36 & 37), 9, 35(6), 35(8) and 51, for allegedly catching fish at night in the Kunnipuzha river near Pathrakadavu range using battery and wire on 25.02.2020. The matter was heard via video conference on 15.09.2020. The petitioners’ counsel contended that no offence has been made out even if the allegations are accepted and expressed willingness to comply with conditions if bail is granted. The Public Prosecutor opposed bail, noting that the 1st accused is already arrested and that the petitioners are implicated based on the confession statement of the 1st accused, making custodial interrogation necessary. The court emphasized the social distancing need in prisons in light of COVID-19 and cited higher court precedents. Referring to Chidambaram P. v. Directorate of Enforcement, the court reiterated that bail is the rule and custody is the exception. The court ultimately allowed bail on stringent conditions: appearance before IO within ten days; possible arrest followed by bond of Rs.50,000 with two sureties; ongoing cooperation; no travel outside India without court permission; no offending; regular appearances on Mondays; adherence to COVID-19 guidelines, with possibility of cancellation for non-compliance.

The above case is registered against the petitioners alleging offences punishable under Sections 2(15,16,21,22,24A,35,36 & 37), 9, 35(6), 35(8) and 51 of Wild Life Protection Act, 1972.** **3. The prosecution case is that, on 25.02.2020 during night, the petitioners and other accused were found catching fish using battery and wire at Kunnipuzha river near Pathrakadavu range. The public prosecutor submitted that, the 1[st] accused is already arrested. The petitioners are implicated in this case based on the confession statement of the 1[st] accused. The public prosecutor submitted that, the custodial interrogation of the petitioners are necessary in this case.** **7. Admittedly, the petitioners were implicated in this case based on the confession statement of the 1[st] accused. I do not want to make any observation about the merit of this case. Considering the entire facts and circumstances of this case and also considering the fact that, there is already an interim order infavour of the petitioners, I think, this application can be allowed on stringent conditions.** **8. Moreover, considering the need to follow social distancing norms inside prisons so as to avert the spread of the novel Corona Virus Pandemic, the Hon'ble Supreme Court in Re: Contagion of COVID19 Virus In Prisons case (Suo Motu Writ Petition(C) No.1 of 2020) and a Full Bench of this Court in W.P(C)No.9400 of 2020 issued various salutary directions for minimizing the number of inmates** B.A. NO.1785 OF 2020 5 **inside prisons.** **9. Moreover, it is a well accepted principle that, the bail is the rule and the jail is the exception. The Hon'ble Supreme Court in Chidambaram P. v. Directorate of Enforcement (2019 (16) SCALE 870), after considering all the earlier judgments, observed that, the basic jurisprudence relating to bail remains the same inasmuch as the grant of bail is the rule and refusal is the exception so as to ensure that, the accused has the opportunity of securing fair trial.** **10.
