Case Synopsis & Summary

This is a bail application under Section 439 CrPC by seven accused in Crime No.156/2024 of Pattambi Police Station, Palakkad, seeking bail in connection with offences punishable under Sections 143, 147, 148, 324, 332 and 353 read with Section 149 IPC. The petitioners were arrested on 4 March 2024. The crux of the prosecution’s case is that on 3 March 2024, during a procession in connection with a festival at Pattambi, the accused acted in concert, armed with iron sticks and stones, and engaged in a violent clash; when the police officer on duty attempted to intervene, the accused allegedly hurled a stone injuring him on the nose, obstructing his official duties. The prosecution contends that the investigation is ongoing and that releasing the petitioners on bail would hamper the inquiry. The petitioners contend they are innocent and have been falsely implicated; they allege that Sections 353 and 332 were added to deny bail. They point out that custody since 4 March 2024 has been brief and that investigation is practically complete with recoveries effected. On hearing, the court noted the factual matrix, and having regard to the proximity of the incident but the nearly completed investigation, granted bail subject to bonds of Rs.50,000 with two solvent sureties each and standard conditions, including appearance before IO on Saturdays for a month, a non-tampering clause, surrender of passport, and power to cancel bail for violation, citing Sushila Aggarwal for the legal framework.

The petitioners submit that they are innocent and falsely implicated; they were in custody since 4.3.2024, investigation is practically complete, and recovery has been effected. They contend that Sections 353 and 332 were added to deny bail and seek release on bail to assist the ongoing inquiry.

Contentions of Respondents

The learned Public Prosecutor opposed bail, highlighting that a police officer was injured during the incident, the investigation is ongoing, and release on bail would impede the inquiry.

She submitted that the police officer had suffered injuries on his nose. She made available the accident register cum wound certificate issued by the Sevana Hospital & Research Centre, Pattambi dated 4.3.2024, to substantiate her assertions. She submitted that the investigation is in progress. If the petitioners are released on bail, it would hamper with the investigation. Hence, the application may be dismissed. 6.
