Case Synopsis & Summary
Petitioner A.V. Thomas sought a building permit to construct a commercial building on land described as paddy land in revenue records. The Respondent RDO declined permission, replying that the property, being paddy land, cannot host a commercial structure in light of the Government Circular Ext.P11. The petitioner challenged Ext.P10, a clarification issued by the RDO based on Ext.P11, contending that Ext.P11 was quashed by Sivadasan v. Revenue Divisional Officer (2017) and that the property had been converted prior to the Kerala Conservation of Paddy Land and Wetland Act, 2008, which would exempt it from the Act. He urged that Ext.P10 be interfered with and that Ext.P13 (application) be decided, so as to obtain permission under Clause 6(2) of the Land Utilisation Order, 1967 (Kerala). The Panchayat, Local Level Monitoring Committee and District Collector were impleaded. The Court held that Ext.P10 is liable to be interfered with since Ext.P11 has been quashed in Sivadasan, and that if the land was converted prior to the Act, the Act may not apply, citing Jalaja Dileep and Puthan Purakkal Joseph. Consequently, the petition was allowed; Ext.P10 was quashed. The Court directed the Additional Fourth Respondent to decide Ext.P13 in light of Puthan Purakkal Joseph within one month, and to require a certificate from the LLMC Convener that the land is not shown as wetland or paddy in the data bank, to be produced along with the judgment. If entitlement is shown, a building permit should issue to the petitioner by the second respondent.

Submissions & Arguments
Contentions of Appellants / Petitioners
The petitioner contends Ext.P11 circular (Government directive) has been quashed by Sivadasan (supra) and thus Ext.P10 must be interfered with. He asserts the land was converted prior to the Kerala Conservation of Paddy Land and Wetland Act, 2008, so the Act does not apply; consequently, he should be allowed to use the property for construction after obtaining permission under Clause 6(2) of the Land Utilization Order, 1967, by filing Ext.P13.
Contentions of Respondents
The respondents rely on Ext.P10, which in turn is based on Ext.P11, a circular considered binding under the Act. They contend that the petition seeks to circumvent statutory protection for paddy land and wetlands and that the LLMC and Panchayat are duty-bound to ensure compliance with the Act and related circulars.
