Case Synopsis & Summary

This Public Interest Litigation, filed by Asif Azad in the Kerala High Court, challenges the NEET (UG) examination process, alleging that female candidates were forced to remove innerwear with metallic hooks during frisking, triggering humiliation and mental distress. The petition seeks (i) a mandamus directing the Union of India and the National Testing Agency (NTA) to publish a common nationwide protocol for examinations, (ii) free counseling for victims, and (iii) compensation for alleged violations of Article 21 of the Constitution. The respondents contend the petition fails PIL requirements and that a criminal investigation (Crime No. 1065/22) is ongoing in Chadayamangalam; they emphasize that NEET (UG) has operated nationwide since 2019 under government guidelines and NTA’s 113-page protocol, including gender-sensitive frisking norms. The court notes the incident at a Kollam center, the investigation’s progress, and the ongoing proceedings before a criminal court. It observes that the matter concerns administrative procedures and policy matters appropriate for the executive and criminal courts, not a writ of mandamus. Ultimately, the High Court closes the petition, indicating it will not interfere during ongoing criminal proceedings and leaving the resolution of systemic policy questions to proper fora.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner seeks a mandamus to publish a common national examination protocol, along with direction for counseling and compensation for alleged violations of Article 21, arguing that the NEET examination process and frisking practices caused mental distress to female candidates and breached dignity and constitutional rights. The reliefs are framed as PIL remedies aimed at systemic reform and redress for those affected.

Contentions of Respondents

The respondents contend the petition does not satisfy PIL requirements, emphasizes ongoing criminal investigation into the Kollam incident (Crime No. 1065/22 under IPC sections 354, 509, 109, 34), and relies on established NEET guidelines and the NTA’s framing of national-level examination protocols as administrative prerogatives. They submit that mandating a nationwide protocol is beyond the writ jurisdiction and that any relief sought is personal to the victims; the court should defer to the criminal process and existing guidelines.

As regards prayer No.1, no mandamus can be issued to the respondents to conduct a common protocol to conduct examinations across the country as procedure and protocol depends upon nature of WP(C) NO. 24410 OF 2022 :: 12 :: subjects and selection of candidates.
