Case Synopsis & Summary

The petitioner, Arya Anandan, filed this writ petition challenging the admission process for the five-year integrated LLB course conducted by the Commissioner for Entrance Examinations, Kerala. She claimed reservation under the SEBC category as a Hindu Ezhava, but could not produce the non-creamy layer certificate with her application because of an inadvertent misstatement of family income. She subsequently produced Ext.P5, a non-creamy layer certificate dated 05.10.2020, and asserted entitlement to reservation in Government colleges. The government and the entrance-examination authorities argued that the applicant had to upload the non-creamy layer certificate at the time of submitting the application, and that the prospectus and notifications clearly required the documents in support of SEBC claims to be uploaded and cured within the specified windows. Prolonged COVID-19 disruptions had extended curing opportunities, but the petitioner did not utilize them in a timely manner. In his judgment, the learned judge notes the sequence of notifications from 28.01.2020 to 19.08.2020 and the two allotment phases, stressing that the final category lists were published on 19.08.2020 and the defect-curing period closed before 14.08.2020 and 16.07.2020. Citing earlier Kerala decisions, including Sainulabdin v. State of Kerala, the court held that an application without the requisite documents cannot be treated as valid, and that belated documents cannot validate a reservation claim. Consequently, the writ petition is dismissed for lack of compliance.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner contends she sought SEBC reservation and relied on being Hindu Ezhava; she inadvertently misstated income; she submitted Ext.P5 non-creamy layer certificate dated 05.10.2020 and seeks admission under SEBC after late certification. She points to the Covid-19 disruptions and the multiple notifications extending opportunities to cure defects and upload documents.

Contentions of Respondents

The respondents contend that the prospectus and notifications mandated uploading the non-creamy layer certificate with the application and curing defects within set windows; without such documents, SEBC reservation cannot be claimed, and belated certification cannot validate the application.

Thereafter by notification dated 19.08.2020, the final category-wise lists of candidates, who have qualified for the Five Year LLB Course-2020, were published.** **4. It is further stated that the first phase of allotment was published as per notification dated 21.08.2020, based on online options submitted by candidates. Despite the opportunities, which were available to petitioner on the basis of the notifications mentioned above, petitioner did not take care either to obtain a non-creamy layer certificate or to cure the defects in her application, in time and to upload such certificate. It is seen that she could obtain a non-creamy layer certificate only on 05.10.2020, when the time for availing the opportunities for curing the applications and curing the defects and even the 2[nd] allotment was over.** **6.
