Case Synopsis & Summary

Arun Raj, a devotee of Sree Vallabha Temple at Mathilbhagom, filed a writ petition under Article 226 seeking a mandamus to compel the Travancore Devaswom Board and associated authorities to constitute a Temple Advisory Committee at Sree Vallabha Temple as per Ext.P2 bye-laws. During proceedings, the court suo motu added the Ad-hoc Committee (R5) representing the temple, with directions for notices and counter-affidavits, as the matter involved urgent temple construction. The petition challenges the constitution of the Ad-hoc Committee under the Board’s oversight as inconsistent with Ext.P2, and seeks quashing Ext.P9(a). The core legal questions concern the statutory basis for Temple Advisory Committees created by Section 31A of the Travancore-Cochin Hindu Religious Institutions Act, 1950, and the rule-making power under Section 122, with Ext.P2 Rules approved by the Court. The judgment clarifies that Ext.P2 Rules govern Temple Advisory Committees, fixing their term and election procedure, a position anchored by the Supreme Court’s and this Court’s prior rulings, notably in Chandu K. and Others v. Travancore Devaswom Board. The Court disposes the petition with directions: (i) construction at the temple must be completed within four months with ad-hoc accounts audited; (ii) after four months, the 3rd respondent will initiate elections to the Temple Advisory Committee under Ext.P2 by a general meeting of registered members, in accordance with the Rules. The matter of other contentions remains open for appropriate fora.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner contends that Ext.P2 provides the statutory mechanism for constituting a Temple Advisory Committee and that the Ad-hoc Committee constituted under the Travancore Devaswom Board is illegal. He seeks mandamus to constitute a Temple Advisory Committee as per Ext.P2 and to quash Ext.P9(a).

Contentions of Respondents

The respondents maintain that the Ad-hoc Committee is necessary to oversee ongoing temple construction and that elections to the Temple Advisory Committee should be conducted after construction is completed, within a four-month window, with accounts audited. They rely on Ext.P2 and Clause 21 to argue limitations on the Commissioner’s powers and emphasize compliance with Ext.P2’s election procedures.

By the order of this Court dated 24.02.2022 in I.A.No.3 of 2022, this writ petition was amended and the petitioner produced amended writ petition. By way of the said amendment, the following two additional reliefs are sought for, -4- W.P.(C). No. 28387 of 2021 i.e., a declaration that the constitution of Ad-hoc Committee at Sree Vallabha Temple, under Travancore Devaswom Board, instead of Temple Advisory Committee, as provided in Ext.P2 bye-laws, is highly unfair and illegal; and a writ of certiorari to quash Ext.P9(a) order dated 10.11.2021. 4. The additional 5[th] respondent has filed a counter affidavit opposing the reliefs sought for in this writ petition, raising various contentions. The petitioner has filed a reply affidavit dated 12.01.2021. The learned Standing Counsel for Travancore Devaswom Board has filed as statement dated 24.01.2022 on behalf of respondents 1 to 4, to which the petitioner has filed reply affidavit on 31.01.2022. An additional counter affidavit has also been filed by the additional 5[th] respondent to the reply affidavit filed by the petitioner to the statement of respondents 1 to 4. 5. Heard the learned counsel for the petitioner, the learned Standing Counsel for Travancore Devaswom Board representing respondents 1 to 4 and also the learned counsel for the additional 5[th] respondent. 6. Section 31A of the Travancore-Cochin Hindu -5- W.P.(C). No. 28387 of 2021 Religious Institutions Act, 1950, deals with the formation of the Temple Advisory Committees. As per sub-section (1) of Section 31A of the Act, a Committee for each temple in the name ‘Temple Advisory Committee’ (name of the temple) may be constituted in order to ensure participation of Hindu devotees. As per sub-section (2) of Section 31A, the Temple Advisory Committee constituted under sub-section (1) may be approved by the Board. As per sub-section (3) of Section 31A, the composition of an Advisory Committee under sub-section (1) shall be in such manner as may be prescribed by the rules made by the Board, not inconsistent with any practice, prevailing, if any. Section 122 of the Act deals with the power to make rules. As per sub-section (1) of Section 122, the Board may, with the prior approval of the Government, make rules to carry out all or any of the purposes of this Act not inconsistent therewith. As per sub-section (2) of Section 122, in particular and without prejudice to the generality of the foregoing power, the Board shall have the power to make rules with reference to the matters enumerated in clauses (a) to (g). W.P.(C). No. 28387 of 2021 -6- 7. In terms of sub-section (3) of Section 31A of the Act, read with the provisions under Section 122, the Travancore Devaswom Board framed Ext.P2 Rules for the formation of Temple Advisory Committees in the temples under the Board. The draft rules have been approved by this Court, by the order dated 03.11.2011 in DBA No.153 of 2019. As per Clause (11) of Ext.P2 Rules, the term of an elected Temple Advisory Committee shall be two years from the date on which the Devaswom Commissioner grants approval, under Clause (8) of Ext.P1 Rules, to the list of elected members forwarded by the Assistant Devaswom Commissioner. 8. In **Chandu K. and others v. Travancore Devaswom Board and others [2021 (3) KHC 379]** a Division Bench of this Court held that, with the insertion of Section 31A to the Travancore Cochin Hindu Religious Institutions Act the formation of Temple Advisory Committees in temples has become statutory. In the said decision, the Division Bench noticed that, the Travancore Devaswom Board, in exercise of the rule making power under clause (a) of subsection (2) of Section 35 of the Act, has framed rules for the -7- W.P.(C). No. 28387 of 2021 formation of Temple Advisory Committees in temples under Travancore Devaswom Board and this Court has approved the draft bye laws by the order dated 03.11.2011 in DBA No. 153 of 2009. Clause (11) of the Rules deals with the term of office of the Temple Advisory Committee. Thus, the term of the ## committees is statutorily fixed. 9. Clause (5) of Ext.P2 Rules, which deals with election, reads thus; “5. As per Clause (5) of Ext.P2 Rules, the Assistant Devaswom Commissioner shall convene a general meeting of registered devotees to elect members other than the -8- W.P.(C). No. 28387 of 2021 permanent members of the Advisory Committee. For that purpose, notice shall be given to the members at least one week before the scheduled meeting. At the meeting so convened the members of the Advisory Committee shall be elected by consensus. If, for any reason, names of more than the prescribed number of members to be nominated are suggested, the names of prescribed number of members shall be drawn by lots in front of the sanctum sanctorum, in the presence of the Assistant Devaswom Commissioner. 11. As held by this Court in **Chandu K.** ' s case, after Ext.P2 Rules, the term of the Temple Advisory Committee and also the procedure for electing such a committee are statutorily fixed. The qualification for being an elected member of the Temple Advisory Committee is specifically provided in the Rules. The normal term of the elected Advisory Committee is two years. Extension of the term of elected committee is permitted in exceptional circumstances as provided in clause (11) of Ext.P2 Rules. In **Chandu K.** ' s case supra, the Division Bench has made it clear that as per the normal rules, the term of the elected Temple Advisory -9- W.P.(C). The learned counsel for the petitioner would submit that the interest of the petitioner is only to see that the Temple in question is having an elected Temple Advisory Committee, as per the procedure contemplated in Ext.P2 Rules. 15. The learned counsel for the additional 5[th] respondent would submit that the members of the Ad-hoc Committee have absolutely no intention to continue to hold office indefinitely. Their intention is only to see that the construction activities undertaken in the temple are completed without any delay. A period of six months is required for -11- W.P.(C). No. 28387 of 2021 completing the construction activities and thereafter a duly elected Temple Advisory Committee can be constituted in the temple as per the procedure contemplated in Ext.P2 Rules. 16. The learned Standing Counsel for Travancore Devaswom Board would submit that the 3[rd] respondent Assistant Commissioner shall take necessary steps to conduct election to the Temple Advisory Committee of Sree Vallabha Temple, in the manner provided in Ext.P2 Rules, immediately after completion of the construction activities undertaken by the additional 5[th] respondent Ad-hoc Committee and such an exercise shall be undertaken by the 3[rd] respondent, within a period of four months from today. 17. Having considered the submissions made by the learned counsel on both sides, we deem it appropriate to dispose of this writ petition with the following directions; 1. The 3[rd] respondent Assistant Commissioner and also the 4[th] respondent Sub Group Officer shall take necessary steps to ensure that the construction activities undertaken at Sree Vallabha Temple, Mathilbhagom, by the additional 5[th] respondent Adhoc Committee, in respect of which agreements have already been executed, is completed within a period of four months from the date of this judgment. The -12- W.P.(C). No. 28387 of 2021 accounts of the Ad-hoc Committee shall be subjected to audit by the competent authority. 2. After the expiry of the aforesaid period of four months, the 3[rd] respondent Assistant Devaswom Commissioner shall initiate steps for conducting election to the Temple Advisory Committee of Sree Vallabha Temple, Mathilbhagom, by convening a general meeting of the registered members, as per the procedure contemplated in Ext.P2 Rules. 18. The legal and factual contentions raised by the petitioner and the additional 5[th] respondent, other than those relating to the constitution of Temple Advisory Committee as per the provisions under Ext.P2 Rules, are left open to be raised before the appropriate forum at appropriate stage. It is made clear that, if due to any compelling circumstances some more time is required for completing the construction activities referred to hereinbefore, it would be open to the additional 5[th] respondent Ad-hoc Committee to file an interlocutory application in this writ petition seeking extension of time. ## **Sd/-** ## **ANIL K.
