Case Synopsis & Summary
Arun Gopinathan, the petitioner, challenges Ext.P1 of the Kerala Administrative Tribunal (KAT) which dismissed his OA 584/2015. He sought a direction to the Public Service Commission (PSC) to advise for appointment only from Annexure A2’s rank list who possess the amended qualifications for the post of Lecturer in Mechanical Engineering in the Technical Education Department. The notification inviting applications (Annexure A1) preceded AICTE's amendment (Annexure A3) on 5 March 2010, which redesignated the post as Assistant Professor and introduced a new set of qualifications. Annexure A4 records the State Government’s implementation, and Annexure A5 (21 June 2013) orders revision of qualifications to be incorporated into the Kerala Education Special Rules, 1967 (Class B Service). Notably, Annexure A2 rank list was published on 18 February 2013, before Annexure A5. The petitioner argues that the amended qualifications should govern appointments and that continuing to operate Annexure A2 would promote unqualified candidates. The respondents contend that the Special Rules have not been amended, so PSC remains bound by unamended qualifications, and the rank list remains valid. The High Court concludes that since the Special Rules are not amended, the AICTE amendments cannot retroactively affect the rank list, and dismisses the petition. The case centers on the retroactivity and incorporation of amended qualifications into state rules for appointment to Civil Posts in engineering education.

Contentions of Appellants / Petitioners
The petitioner contends that Annexure A3 amendments of AICTE (5.3.2010) redesignated the post of Lecturer as Assistant Professor and introduced revised qualifications. Annexure A4 shows the State Government implementing the same, and Annexure A5 (21.6.2013) directs incorporation of these amended qualifications into the Kerala Education Special Rules, 1967. Since Annexure A2 rank list was published on 18.02.2013, before Annexure A5, the amended qualifications should govern appointment; relying on the Full Bench Mohanan decision, the petitioner argues that appointments should be limited to vacancies existing before the amendment and that persons 5–22 on Annexure A2 lack the amended qualifications. He seeks to dislodge them from the rank list and to appoint only those qualified as per amendments.
Contentions of Respondents
The respondents submit that the Kerala Public Service Commission is bound by the existing Special Rules (Class B Service, 1967) which have not been amended to reflect the AICTE amendments. Although Annexures A3–A5 introduce revised qualifications, these cannot automatically override unamended state Rules. The KAT’s reasoning was correct in holding that, until the Special Rules are amended, the PSC cannot operate on the amended qualifications. Thus, the rank list prepared under unamended rules remains valid; to implement amended qualifications would require formal amendments to the rules and probably a fresh notification.

| Case Name | Citation | Treatment | Explanation |
|---|---|---|---|
| Mohanan v. Director of Homeopathy | 2006(3)KLT 641 (FB) | Distinguished | The Full Bench decision is cited by the petitioner to argue that unamended qualifications could be used only for vacancies existing before the amendment; however, the High Court distinguishes this decision since the Kerala Special Rules had not been amended, making the Mohanan ruling inapplicable to the present facts. |
