Case Synopsis & Summary

This Public Interest Litigation challenges the conduct of Kalapoottu (bullock-cart races), Kannupoottu and Maramadi (cattle races) organised by the sixth respondent in Kollam district, alleging cruelty to animals and violation of central and constitutional protections. The petition relies on a chain of authority starting with the Central Government notification (G.S.R. 528(E)) issued under the Prevention of Cruelty to Animals Act, 1960 (PCA Act) and the Supreme Court’s decision in Animal Welfare Board India v. Nagaraja, which upheld the ban on performing animals such as bulls in Jallikattu and related events. The Kerala authorities (State, District Collector, Police, etc.) are accused of inaction despite complaints and a 26 August 2022 District Collector order prohibiting the events. The petition also cites Kerala High Court’s 2015 decision in Cattle Race Club of India v. State of Kerala (and related circulars Exhibits P2-P7) to contend that such events violate the PCA Act and the Constitution. In response, respondents defend the circulars and orders as consistent with jurisprudence; the court ultimately finds that the district authorities have issued prohibitory measures and makes the interim order absolute, disposing of the writ petition by reinforcing these prohibitions and directing strict implementation by all authorities.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner contends that Kalapoottu, Kannupoottu and Maramadi events constitute cruelty to animals and are illegal under the PCA Act and the central notifications (G.S.R. 528(E)) and the Nagaraja decision. They rely on Exhibits P2-P4 (circulars and government notifications) and the Kerala High Court's pronouncements in previous related cases (e.g., Cattle Race Club of India v. State of Kerala) to urge the Court to issue writs of mandamus restraining the sixth respondent and to declare such activities illegal. They emphasize lack of registration of the sixth respondent with AWBI and absence of proper permissions, urging immediate action by the District Collector and police authorities to prevent cruelty and uphold the constitutional framework for animal welfare.

Contentions of Respondents

The respondents argue that the government circulars, district orders and central notifications reflect compliance with the Nagaraja decision and are protective of animal welfare. They highlight that the sixth respondent is a non-registered entity and that the authorities have issued binding orders (notably the 26 August 2022 order by the District Collector prohibiting bull races). They rely on Exhibits P2-P7 and the 2016 MoEFCC notification (G.S.R. 13(E)) to justify enforcement and to argue that the State must regulate such events to prevent cruelty, consistent with prior judicial pronouncements and public interest objectives.
