Case Synopsis & Summary

This writ petition challenges KEAM 2020 admissions on the ground that the Akshaya centre uploaded a Non-Creamy Layer (NCL) certificate intended for state employment rather than education, causing the petitioner to be shown in General category. The petitioner contends she belongs to the Dheevara community and is eligible for SEBC reservation; she had rank numbers in NEET UG 2020 and Kerala state medical ranking. Upon discovering the error, she obtained Ext.P9 (NCL certificate dated 10-11-2020) and submitted Ext.P10 (representation) seeking rectification to reflect SEBC status. She asserts the poverty of her family and the need to consider her for SEBC reservation, arguing that the mistake was at the Akshaya centre and that she acted promptly. The respondents rely on a long line of precedents which emphasize adherence to the online application procedure and mandatory certificates; they point out that certificates uploaded with the online application are the ones to be entertained and rely on decisions in Simi Raj (1999 KHC 669) and Sainulabdin (1995 KHC 362) to stress the mandatory nature of certificates. The Court also cites multiple prior KEAM cases and judgments (W.P.(C).No.21474/2020; W.A.No.1080/2020; W.A.No.1183/2020; W.A.No.1404/2020) and concludes that the petition should be dismissed, upholding the established procedure. The petitioner is urged to be vigilant when submitting applications.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner submits that the Akshaya centre uploaded the wrong Non-Creamy Layer certificate intended for State Employment rather than the State Educational purpose, thereby placing her in the General category. She had no control over the uploaded documents and promptly obtained Ext.P9 (NCL) on 10-11-2020 and filed Ext.P10 seeking rectification. She argues that she belongs to SEBC (Dheevara) and should be considered for reservation. Since several notifications and the KEAM prospectus emphasize that claims for special/mandatory reservations must be made in the online application and supporting documents uploaded within stated times, a rectification mechanism should be allowed rather than dismissing the petition. The petitioner relies on the need for equitable treatment given her poor family background and asserts that the administrative process has not allowed proper rectification of the error despite prompt action.

Contentions of Respondents

The respondents contend that the KEAM 2020 process follows a strict, transparent procedure where only certificates uploaded with the online application will be entertained. They cite guidelines and notifications from 07.11.2019 to 10.09.2020 and contend that the required SEBC/NCL certificates must be uploaded in the prescribed format and at the proper time; the community certificate is mandatory as per the prospectus and even the application form (citing Simi Raj and Sainulabdin). They argue that the petition cannot be allowed to upset the established process and remind that the petition was not timely rectified within the stipulated windows; the petitioners were provided multiple opportunities to cure defects, and the state cannot be faulted for lapses beyond those deadlines.

I have already considered similar cases where the petitioners appeared even at an earlier stage and rejected similar contentions, following the judgments of the Division Bench in W.A.No.1080/2020 and W.
