Case Synopsis & Summary

This is a consolidated High Court of Kerala order disposing six bail applications filed by Antony Sunny, the 2nd accused in Crime No. 35/2023, Mukkom Police Station, Kozhikode, and the 2nd accused in related cases across various Kozhikode police stations. The petitions, filed under Section 439 CrPC, were heard on 07.11.2023. The prosecuting agency charges the petitioner with offences under sections 409, 420 read with 34 IPC and provisions of the BUDS Act 2019, alleging deceit and non-repayment of deposits. The petitioner was arrested on 05.09.2023; no charge sheet has been filed yet, and he has several prior arrests in other matters. The prosecution asserts there are about 190 cases against the petitioner, with bail granted in 164, but emphasizes that the present investigation has progressed, the passport has been surrendered, and most evidence is documentary. The petitioner’s counsel contends that the delay in filing charge sheets, combined with the progress of investigation and absence of immediate danger to witnesses, justifies statutory bail under CrPC 439. The Public Prosecutor counters with the sheer volume of cases and the ongoing investigation. The court ultimately grants bail in all six applications, subject to standard conditions, including bonds, sureties, reporting, address disclosure, no witness intimidation, no leaving Kerala, and passport surrender; the decision notes police may investigate and recover despite bail, citing Sushila Aggarwal v. State (NCT of Delhi).
