Case Synopsis & Summary

The petitioners are licensees of toddy shops in the Kuttanad Range, Alapuzha, holding licences issued under the Abkari Act for the year 2020-21 (Exts P2–P13). They filed this writ petition under Article 226 seeking a mandamus to respondents 1–6 to provide adequate police protection for the smooth conduct of toddy shops in several groups within the Kuttanad Range, without obstruction or interference from respondents 8–13 and others. They also prayed for a writ restraining the striking workers allied to respondents 8–13 from agitating within 200 metres of their shops. The petition relies on Ext P1 (dated 02.11.2020) alleging obstruction by unions and workers, interference with transport of toddy, and demands for higher wages beyond what the industry can bear. The petitioners claim that unlawful activities threaten the operation and licensing conditions and seek immediate police protection and preventive action against illegal sales by workers. Counter affidavits were filed by respondents 8 and 9 opposing reliefs. After hearing, the court recorded the petition as withdrawn on 26.11.2020, with liberty for the petitioners to file individual complaints or writ petitions if inaction occurs.

Legal Doctrines & Maxims

  • Facts and evidence must be pleaded in writ petitions and counter affidavits; lack of pleaded facts or evidence prevents entertaining a point (Bharat Singh v. State of Haryana, (1988) 4 SCC 534)

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contend they are licensed toddy shop operators under the Abkari Act and that their licensees will be jeopardized without police protection. They seek a mandamus to respondents 1–6 to provide security for the smooth conduct of toddy shops listed in Exts P2–P13 and to prevent obstruction by respondents 8–13 and their associates. They further seek to restrain protests by the unions within 200 metres of the shops and to ensure action against illegal sales by workers, invoking the Abkari Act licensing regime and the extant licenses. Counter affidavits were filed by respondents 8 and 9 opposing reliefs. They requested withdrawal of the petition with liberty to approach SHO offices with individual complaints if inaction occurs.

Contentions of Respondents

Respondents oppose the reliefs, contending no substantive material has been shown to justify extraordinary relief under Article 226. They rely on the counter affidavits and government/ labour department materials (Exhibits R8) to show regulatory actions and lawful protest rights. The matter was argued with representation by the government pleader for respondents 1–7 and counsel for respondents 8–9; the respondents urge maintaining order and compliance with licensing norms rather than granting blanket police protection.

The petitioners have also sought for a writ of mandamus commanding respondents 1 to 5 to restrain the striking workers having allegiance to respondents 8 to 13 from conducting agitations within 200 meters radius of the toddy shops of the petitioners. 2. On 10.11.2020, when this writ petition came up for admission, the learned Government Pleader took notice for respondents 1 to 7. Urgent notice by speed post was issued to respondents 8 to 13. 3. Counter affidavits have been filed on behalf of respondents 8 and 9, opposing the reliefs sought for in this writ petition. They have also filed additional counter affidavits. 4. Heard the learned counsel for the petitioners, the W.P.(C) No.24126 OF 2020(M) 5 learned Senior Government Pleader for respondents 1 to 7 also the learned counsel for all the party respondents. 5. In **Bharat Singh v. State of Haryana [(1988) 4 SCC 534]** the Apex Court held that, when a point which is ostensibly a point of law is required to be substantiated by facts, the party raising the point, if he is the writ petitioner, must plead and prove such facts by evidence which must appear from the writ petition and if he is the respondent, from the counter affidavit. If the facts are not pleaded or the evidence in support of such facts is not annexed to the writ petition or to the counter affidavit, as the case may be, the Court will not entertain the point. The Apex Court held further that there is a distinction between a pleading under the Code of Civil Procedure Code, 1908 and a writ petition or a counter affidavit. While in a pleading, i.e., a plaint or a written statement, the facts and not evidence are required to be pleaded, in a writ petition or in the counter affidavit not only the facts but also the evidence in proof of such facts have to be pleaded and annexed to it. 6. The reliefs sought for in this writ petition are based on Ext.P1 complaint dated 02.11.2020 filed before respondents 1 to 5, the Station House Officers of the respective Police Stations. The said complaint reads thus: W.P.(C) No.24126 OF 2020(M) 6 “We the undersigned bring the following complaints to your goodself for necessary action.
