Case Synopsis & Summary
Anitha A, aged 52, was appointed High School Assistant at Viswabharathi Model Higher Secondary School, an aided institution managed by the fifth respondent. The school was upgraded to a Higher Secondary School in 2014-15, and Anitha A claimed the post of Principal on the ground that she was qualified. When no action was taken, she approached this Court in W.P.(C) 15974/2021, and, following directions, the Government issued Exhibit P6 on 13.12.2021; the Manager granted her promotion. Following Exhibit P7, the Manager forwarded the proposal to the Regional Director, Chengannur. When no action followed, she filed W.P.(C) 14709/2022. The Court disposed of that petition by directing the 2nd respondent to consider and pass appropriate orders on the proposal for approval of the appointment as Principal, expeditiously within two months, while ensuring compliance with binding Government Orders and judgments of this Court on the issue. As regards salary, the Court held that she, in any event, is entitled to the salary of Headmistress until approval is granted, and directed the 3rd and 4th respondents to disburse that salary within three weeks. The petitioner later challenged Exhibit P16, an order rejecting approval for Principal, contending it violated the Court’s directions and the Jayaraj VP decision (2016). The Court found P16 unsustainable, quashed it, and directed the 2nd respondent to reconsider in light of Exts P15, P17 and P18–P22, expeditiously within two months. The judgment closes with a directive to ensure compliance and salary protection.
Legal Doctrines & Maxims
- 2:1 ratio for cadre of Headmaster to Principal in Higher Secondary section; when Headmaster is promoted and HSSTs are available for all subjects, the junior-most HSST in that subject would be continued as supernumerary; if the Headmaster's subject is not available in Higher Secondary, he may be exempted from teaching hours (16 hours).
Submissions & Arguments
Contentions of Appellants / Petitioners
The petitioner contends that Exhibit P16, the order of the 2nd respondent rejecting the approval of the appointment as Principal, cannot be sustained in light of the directions issued by this Court in Exhibit P15 and the binding law laid down in Jayaraj V.P (2016). She argues that since the Government's orders and the Court's judgments require consideration of the proposal and compliance with the 2:1 ratio in cadre for Headmasters promoted to Principal, the 2nd respondent was obliged to approve the appointment or defer to a proper determination with due regard to HSST availability. Pending approval, she is entitled to salary in the Headmistress cadre and that the Manager’s earlier action to promote her stands; failure to comply with directions resulted in a violation of the Court's order and prejudice to her. She seeks (i) to set aside P16 and (ii) to direct the respondents to approve her appointment as Principal and to pay all dues and salary.
Contentions of Respondents
The judgment does not explicitly set out separate arguments by the respondents; the court primarily addresses the petitioner’s contentions and the legal doctrine invoked, focusing on the validity of Exhibit P16 and the need to reconcile with prior directions and judgments.

|---|---|---|---|
| Jayaraj V.P and another v. State of Kerala and others | 2016 KHC 419 | Positive | Cited by the court to support the proposition that a Headmaster promoted as Principal in the Higher Secondary section, where HSSTs exist for all subjects, should be accommodated with supernumerary posts for HSSTs and exempt from teaching hours if needed; the P16 order was found not justified in light of this ratio. |
