Case Synopsis & Summary

This writ petition challenges SARFAESI proceedings initiated by The South Indian Bank Ltd. against petitioners Anil Kumar P.C. and Deepa S.S., including possession and sale notices for gold ornaments. The petitioners contend that the proceedings arose during the Covid-19 period and contend that limitation was suspended by Supreme Court orders; thus they seek relief under the SARFAESI Act. The Kerala High Court reference to United Bank of India v. Satyawati Tondon and Authorized Officer, State Bank of Travancore v. Mathew K.C. underscores a settled view: writ petitions challenging SARFAESI proceedings are generally not entertained, given the Act provides a speedy recovery framework and an available remedy under Section 17 before the Debt Recovery Tribunal (DRT). Consequently, the Court held that the writ petition cannot be entertained and directed the petitioners to pursue the Section 17 remedy, relegating them accordingly. Acknowledging extraordinary Covid-era circumstances, the Court granted limited relief by permitting an application under Section 17 within 45 days from 28 February 2022, to be treated as timely by the DRT, and by keeping the Section 13 (possession) proceedings in abeyance for 45 days. The order ensures access to the statutory remedy while balancing the exceptional situational facts, with the DRT to decide in accordance with law, including interim orders.

Submissions & Arguments

Contentions of Appellants / Petitioners

Petitioners sought time to approach the statutory remedy under Section 17 of the SARFAESI Act, arguing that the Covid-19 pandemic prompted suspension of limitation and that the writ petition should be entertained in view of extraordinary circumstances. They urged the court to grant 45 days from 28 February 2022 to file a Section 17 application and requested that ongoing 13(8) proceedings be stayed during this period.

Contentions of Respondents

Respondents pressed that SARFAESI provides a specialized, expedited recovery mechanism and that writ petitions challenging SARFAESI actions ought not to be entertained under Article 226; applicants should invoke Section 17 before the Debt Recovery Tribunal (DRT). The court was urged to refrain from extending the writ remedy and to uphold the statutory route for challenge under SARFAESI.

SUDHEER GOPALAKRISHNAN, PP THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON 23.03.2022, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING: W.P.(C)No.894 of 2022 4 ## JUDGMENT This Writ Petition(Civil) is filed by the petitioners challenging the proceedings under Securitisation and Reconstruction of Financial Assets and Reinforcement of Security Interest Act, 2002 (hereinafter referred as SARFAESI Act) initiated against the petitioners, at the instance of the 1[st] respondent. Exhibits P29, P30 and P31 are the notices issued by the 1[st] respondent-Bank in this regard, by invoking their rights under various provisions of SARFAESI Act. 2. In United Bank of India v. Satyawati Tondon and Ors [(2010)8 SCC 110] the Hon’ble Supreme Court deprecated the practice of entertaining Writ Petitions challenging the proceedings initiated under the provisions of W.P.(C)No.894 of 2022 5 SARFAESI Act. In Authorized Officer, State Bank of Tranvancore and Ors. v. Mathew K.C.[(2018)3 SCC 85] also, the aforesaid view was reiterated by the Hon’ble Supreme Court by making serious criticism against the invocation of powers under Article 226 of the Constitution of India in respect of the matters pertaining to SARFAESI Act. The observations made by the Hon’ble Supreme Court in the aforesaid judgments were made by mainly taking into consideration of the fact that, the SARFAESI Act, provides for a special procedure for speedy recovery proceedings and it also provides for alternative remedy to challenge the proceedings by virtue of Section 17 of the Act. In the light of the above specific prohibition, this writ petition cannot be entertained. In such circumstances, I am of the view that, it is only proper that the petitioners be relegated to invoke the W.P.(C)No.894 of 2022 6 alternative remedy, as contemplated under Section 17 of the SARFAESI Act. 3. The learned counsel for the petitioners submitted that, he may be granted some time for initiating proceedings by invoking their right under Section 17 of the Act. The proceedings which are under challenge in this Writ Petition were initiated during the period of Covid-19 pandemic and by virtue of various orders passed by the Hon’ble Supreme Court in this regard, the period of limitation stood suspended during the relevant period. The order of suspension of the period of limitation has come to an end with effect from 28.2.2022. 4. In such circumstances, taking note of the extra ordinary circumstances which was in existence at the relevant time, I am of the view that, some indulgence can be shown by providing a breathing time to the petitioners. W.P.(C)No.894 of 2022 7 Accordingly, it is ordered that, if the petitioners submit an application under Section 17 of the SARFAESI Act within a period of 45 days from 28.2.2022, the same shall be entertained by the Debt Recovery Tribunal by treating the same as an application submitted in time and shall consider the same in accordance with law. In order to enable the petitioners to invoke the said remedy, all the recovery proceedings initiated against the petitioners at the instance of 1[st] respondent-Bank against the petitioners by invoking their rights under Section 13 of the SARFAESI Act shall be kept in abeyance, for a period of 45 days from 28.02.2022. Upon submission of an application under Section 17 of the SARFAESI Act, the Debt Recovery Tribunal shall take a decision thereon which would include a decision in respect of an interim order as well, in accordance with law, W.P.(C)No.894 of 2022 8 untrammeled by any of the observations made herein.
