Case Synopsis & Summary

Angels Nair, General Secretary of Animal Legal Force Integration, filed WP(C) No.23538 of 2020 in the Kerala High Court challenging actions by respondents 2 and 3 and their family following a viral video showing alleged cruelty to an elephant. The petitioner states that after he lodged a complaint with respondent 5 regarding the incident depicted in Ext.P1, the respondents or their relatives retaliated by issuing multiple lawyer notices (Exts.P3–P6) demanding substantial sums and by filing civil suits against him and his associates. Respondent 2 allegedly filed OS 191/2019 in Mannarkkad Munsiff Court; respondent 3 filed OS 7/2020 in Ottapalam Munsiff Court, both claiming damages connected to the same incident, which the petitioner contends are fabricated and part of an attempt to vex him and obstruct judicial functioning. The petitioner pleads harassment and seeks reliefs including mandamus and directions to scrutinize related proceedings, investigation into the alleged fabrications, and compensation for mental distress. He asserts that he is discharging constitutional duties under Article 51A(g) to protect animals. The court, however, notes that ordinary civil proceedings must be addressed in the subordinate courts, and intervention by this court requires a showing of frivolousness or abuse of process. The writ petition is ultimately dismissed, with a clear disclaimer that merits of the original suits have not been considered and that the petitioner may pursue proper remedies elsewhere.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner contends harassment by respondents 2 and 3 and their family members, who have issued lawyer notices and filed several civil suits in retaliation for the petitioner’s complaint regarding cruelty to the elephant depicted in Ext.P1. He asserts he has fulfilled his constitutional duty under Article 51A(g) to protect animals and seeks mandamus, guidelines to scrutinize related proceedings, investigation into alleged fabrications, compensation for distress, and monitoring of frivolous actions.

Contentions of Respondents

The respondents (as represented by the court) contend that the civil suits filed by the 2nd and 3rd respondents and their relatives are proceedings in the ordinary course and should not be interfered with by this court. They argue that a writ petition cannot be used to halt or scrutinize pending civil matters absent a demonstration of frivolousness or abuse of process. The court should not substitute its view for the subordinate judiciary’s assessment, and the petitioner must substantiate that any civil actions are frivolous or false before relief can be granted.
