Case Synopsis & Summary

This petition challenges the MBBS fee fixation for the academic year 2024-25 and subsequent years, raised by 50 NEET-qualified candidates in Kerala. The first phase allotment for MBBS admission was notified on 29-08-2024 by the Commissioner of Entrance Examination, directing provisional payment of fees subject to final fixation. PK Das Institute of Medical Sciences (5th respondent) publicly announced MBBS fees (Ext. P3) with open merit at Rs 7,05,805, special fee Rs 1,04,805 and hostel Rs 2,01,480 for year 1; from year 2 onward, special fee Rs 38,650 and hostel Rs 1,86,360, all subject to fixation by the Fee Regulatory Committee (3rd respondent). The circular Ext. P9–P12 and subsequent actions culminated in a February–March 2025 notification fixing a much higher fee structure (Ext. P9–P12) triggering further petitions. The petition contends admissions without prior approval of the FRC, non-disclosure of requisite documents, and a lack of transparency in fee fixation. The petitioners relied on the doctrine of legitimate expectation and argued that the FRC’s order was inconsistent with the Act and policy, while the respondents argue the FRC properly exercised its statutory authority under the 2006 Act (Sections 6(4), 11(e), and 11(2)) and that the writ court cannot act as an appellate authority under Article 226 of the Constitution. The High Court ultimately held that the FRC’s findings were in line with the Act, and dismissed the petition.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contended that the admissions to the MBBS course were completed without prior approval of the Fee Regulatory Committee and that the institution failed to provide timely information and documents necessary for determining a just and non-exploitative fee. They emphasized that provisional fee payments were made under a notification that allowed for adjustment once fees were fixed, and that heavy penalties should not be imposed on students for lapses by the college. They relied on Section 6(4) of the 2006 Act to argue that the committee must scrutinize proposals before the academic year, and on the doctrine of legitimate expectation to challenge the sudden fee hikes as unfair and non-transparent, citing Annexures I and II, MARB permission, and the government order Exts. P3–P7 and P9–P12. They urged the court to examine whether the Fee Regulatory Committee’s order aligns with statutory parameters and to safeguard students from potential exploitation.

Contentions of Respondents

The respondents argued that the Fee Regulatory Committee (FRC) has statutory power under the 2006 Act to regulate fees in unaided professional colleges and to scrutinize fee proposals with supporting documents. They noted that admissions may have proceeded in reliance on approvals and representations, but the order of the FRC was grounded in financial analyses and sectoral considerations, including infrastructure, staff, and development costs, as reflected in Annexure I and II. They asserted that the High Court cannot substitute its own view in place of the expert committee (Article 226 not being an appellate jurisdiction) and that the FRC’s reasons were sound, including consideration of seat expansion from 150 to 200, which would alter cost structures. They cited legitimate expectations as not being a mandatory basis to quash regulatory decisions and argued the court should defer to the regulator’s expertise, as the degree of deference is warranted where statutory objectives are met.

The 5[th] respondent – college did not give any necessary information to fix the fees within the time allegedly fixed by the 3[rd] respondent. 3[rd] respondent ought to have considered that with increase in number of seats from 150 to 200, the expenses will come down. Reliance was also laid to the letter dated 26.04.2023 Ext.P14 of the National Medical Commission Medical Assessment & Rating Board (MARB) granting the permission to increase 50 seats ie., 150 to 200 seats. 6. It was also submitted that the order under challenge is in defiance of the doctrine akin to legitimate expectation under Indian Law as there has not been consistency and predictability in decision making process. The authorities have failed to adhere to the representation without providing adequate reasons, therefore, it violates the trust reposed by the citizen in the State. The judgment in **Sivanandan C.T. and Others** v. **High Court of Kerala** ``` 2025:KER:27821 ``` ``` WP(C) NO. 12269 OF 2025 ``` ``` 14 ``` **==> picture [58 x 57] intentionally omitted <==** **and Others** [(2024) 3 SCC 799] is also cited. 7. We have heard Sri.S.Sreekumar, learned Senior Counsel and of the view that there is no force and merit. 8. Emphatic reliance has also been laid to the notification issued by the Government as a consequence of the order of Fees Regulatory Committee fixing the fees to show that the fees structure of other Medical Colleges is far less than the one fixed by the impugned order. We are constrained to observe that the writ court cannot assume the role of an appellate authority under the realm of powers under Article 226 of the Constitution of India as it is in the domain of the competent authority i.e., Fee Regulatory Committee constituted under the orders of Supreme Court. The Fees Regulatory Committee has taken into consideration various parameters and aspects i.e., availability of infrastructure, teaching and non-teaching staff and ``` 2025:KER:27821 ``` ``` WP(C) NO. 12269 OF 2025 ``` ``` 15 ``` **==> picture [58 x 57] intentionally omitted <==** equipment, expenditure on administration and maintenance as per Section 11(e) of the Act, surplus required for growth and development of professional institutions, statement of tuition fee proposal for MBBS, statement of tuition fee computation, list of faculty members, academic program details, copy of trust deed, copy of audited financial statement of Medical College for the year 2023-2024, copy of audited financial statement of trust, copy of audit report in Form 10B for the financial year 2023-2024, copy of income tax return and total income computation statement for the assessment year 2024-2025, statement containing details of course wise, batch wise tuition fee and special fee provisional and audited, statement containing details of course wise, batch wise Hostel/mess fees, statement of expenditure, loan sanction letter, letter of permission from National Medical Commission, Affiliation order, Minimum Standard requirement etc.. The aforementioned chart reveals that the consumer price index, additional revenue expenses, over dependence on banks for loans and advances, consequent debt-servicing expenditure and capital investment to increase the admission capacity to 200 seats are the factors which led to the precarious situation of mounting deficits and therefore, while undertaking the exercise of regulating the fees, due regard had been to the mandate of law on the subject as per the provisions of Section 11(2) of the Act. Written Down Value of the investment in building and the road used by the college had also been one of the factors. All these factors if looked into cumulative, we are of the view that the findings of fact and law arrived at by the Fee Regulatory Committee manned by the expert committee is in consonance with the provisions of the Act referred to above and cannot be said to be unfair, unpredictable and against the doctrine of legitimate expectation as per the ``` 20 ``` **==> picture [58 x 57] intentionally omitted <==** ``` 2025:KER:27821 ``` ``` WP(C) NO. 12269 OF 2025 ``` ratio deciendi culled out in the judgment cited supra.
