Case Synopsis & Summary

This is a bail application under Section 438 CrPC filed by Ambareesh P D and Sumesh Thathuppara alias Sumesh T B, accused in Crime No.292/2024 of Kelakom Police Station, Kannur, along with eight co-accused, for offences under IPC sections 143, 147, 148, 452, 341, 324, 326 and 427 read with 149. The prosecution alleges that on 05.05.2024, around 9 PM, the accused, in common intention, trespassed into the de facto complainant’s house, dragged him out and assaulted him with wooden sticks, resulting in grievous injuries. The petition seeks pre-arrest bail under Sec.438 CrPC. The petitioners claim innocence and challenge the addition of Section 326 without substantial material, asserting no custodial interrogation is necessary, and that the dispute with respondents 2 and 3 has been amicably settled (Annexure A4). Respondents 2 and 3 state the dispute has been resolved, statements have been recorded, and custodial interrogation is unnecessary for proper investigation. The court notes the settlement and the lack of subsisting grievance, and, after considering the submissions, allows the application, directing surrender within 10 days, bond of Rs.50,000 with two sureties, and other standard bail conditions, citing Sushila Aggarwal for post-bail recoveries.
