Case Synopsis & Summary
This Motor Accident Claims Appeal arises from an award of compensation by the Motor Accidents Claims Tribunal, Kalpetta in O.P.(MV) No.125 of 2009 following injuries to the petitioner, Ahanas, on 08.09.2007 when a private KSRTC bus collided with a KSRTC bus near Kunnamangalam while transporting him from Mananthavady to Kozhikode. The Tribunal held the private bus driver negligent and awarded Rs.67,400 with 7.5% interest and costs. The petitioner challenged the quantum, contending that his income and losses were inadequately assessed. He claimed a monthly income of Rs.5,000, while the Tribunal had fixed Rs.3,000 as notional income. Relying on the Supreme Court’s Ramachandrappa decision (2011) 13 SCC 236, the High Court re-fixed the notional monthly income at Rs.6,000. It recalculated loss of earnings for a 3-month incapacity, pain and suffering, and disability, and made adjustments: increased loss of earnings by Rs.9,000; raised pain and suffering to Rs.20,000; reworked disability at 5% with a 17-multiplier resulting in Rs.61,200 and an additional Rs.30,600 as enhanced disability compensation; augmented loss of amenities to Rs.15,000; deducted Rs.2,000 from loss of earning power. The court finally determined enhanced compensation at Rs.60,600, with 7.5% interest from the petition date and costs, directing the insurer to deposit within two months, while excluding 134 days’ interest per a prior order; the appeal is disposed of accordingly.
Submissions & Arguments
Contentions of Appellants / Petitioners
The appellant contends that the Tribunal’s quantum is inadequate. He asserts a higher notional income, reliance on Ramachandrappa to fix Rs.6,000 per month, and seeks enhanced compensation for loss of earnings during hospitalization, pain and suffering, permanent disability, and loss of amenities, with appropriate adjustments to the total based on age and injury severity.
Contentions of Respondents
Respondents contend the accident occurred due to negligence of the private bus driver and that the claimed quantum is excessive. The insurer acknowledges the policy but challenges liability and the amount. KSRTC drivers deny negligence in the joint statement accompanying the insurer’s stance.
