Case Synopsis & Summary
AFJAL IMAM v. STATE OF BIHAR & ORS. concerns the interpretation of the Bihar Municipal Act, 2007, particularly sections 27, 25(4), 23(3), 21(3), and 21(4). The appellant, elected Mayor, challenged the High Court’s writ petition decision relating to the composition and powers of the Empowered Standing Committee of the Municipal Corporation and the oath to be administered under section 24. The Supreme Court, while hearing Civil Appeal No. 2843 of 2011, granted leave and allowed the appeal, directing that section 27 be read down harmoniously with the other sections of the Act so as to vest the appellant and the seven councillors nominated to the Empowered Standing Committee with the powers of the Mayor and the Committee as provided in the Act, in accordance with law. The Court held that the seven municipal councillors nominated by the appellant are to be part of the Empowered Standing Committee whose functions and authority derive from the Act, and that the District Magistrate Patna must administer the oath of secrecy under section 24 to these councillors. The decision partially allows the writ petition; the order of the Patna High Court is set aside in part, and the appellant’s governance structure is vindicated by a harmonious construction of the statute. In delivering the order, the Court emphasized constitutional governance at the municipal level and the need for a coherent framework to enable the Mayor and the Empowered Standing Committee to function with clearly defined authority while remaining within the statutory scheme. The directive to administer oath of secrecy under section 24 to seven councillors underscores the Court's insistence on confidentiality and loyalty in the performance of duties. The Court's approach reflects a purposive interpretation to preserve effective municipal administration while ensuring compliance with the Act’s provisions. The judgment clarifies the relationship between sections 27 and the other provisions governing membership, elections, and powers of the Mayor and the standing committee, ensuring that the elected office and empowered committee can operate with the requisite authority, avoiding friction due to rigid textual interpretation.

Submissions & Arguments
Contentions of Appellants / Petitioners
The appellant contends that Section 27 of the Bihar Municipal Act, 2007 must be interpreted by reading it down in harmony with Sections 25(4), 23(3), 21(3) and 21(4) to confer powers on the Mayor and the seven Councillors nominated to the Empowered Standing Committee, as provided in the Act. This harmonious construction ensures functional governance and compliance with the statutory framework, including the creation and powers of the Empowered Standing Committee and the associated duties under Section 24 (oath of secrecy).
Contentions of Respondents
The respondents’ submissions relied on the text of the Act as written, contending that the statutory scheme should be applied as-is without over-reading Section 27. They advocate that the High Court’s interpretation should stand unless clearly incompatible with the wording and structure of the Act, maintaining existing limitations and procedural requirements for oath and authority within the municipal framework.
