**WP(C).No. 29945 of 2018 2**
## **JUDGMENT**
Heard Sri. Nidhi Balachandran, learned counsel appearing for the petitioner and Sri.K.P.Sudheer, the learned Standing Counsel appearing for the Cochin Devaswom Board.
2. The petitioner has approached this Court challenging Exts.P24 and P27 orders issued by the Cochin Devaswom Board. The petitioner is working as 'Masappady' under the Board. He was placed under suspension on three occasions. By Ext.P1, the petitioner had been placed under suspension while working as 'Masappady' at Arikaniyoor Temple for dereliction of duty and unauthorised absence. By Ext.P4 proceedings, he was reinstated in service and penalty of bar of one increment and recovery of Rs.1,500/- had been imposed on the petitioner. This was challenged before this Court and Ext.P6 order of stay was issued. The petitioner was transferred to Chottanikkara Devi Temple in the year 2007. On 22.02.2007, there was an incident with regard to counting of money at Chottanikkara Temple. The petitioner was again placed under suspension. It is stated that the criminal case which is charged against the petitioner on the very same allegations with regard to counting of money had ended in Ext.P17 order of
## **WP(C).No. 29945 of 2018 3**
acquittal. Thereafter, by Ext.P18 judgment dated 22.11.2014 this Court had found that the punishment imposed on the petitioner without complying under the procedure under the Classification, Control and Appeals Rules, was illegal and that the entire issue was liable to be reconsidered after forwarding copies of enquiry reports to the petitioner. Paragraph 8 of the judgment reads as follows:-
_8. The 1[st] respondent Devaswom Board is directed to issue fresh show cause in both the cases on furnishing copies of the enquiry reports concerned. The petitioner shall be afforded with opportunity to submit explanations afresh based on the enquiry reports. The matter shall be finalized afresh based on the explanations if any submitted by the petitioner, taking into consideration of the observations contained herein above._
3. It is stated that Exts.P19 and P20 show cause notices were thereafter issued to the petitioner. The petitioner has submitted Ext.P21 reply. It is stated that copies of enquiry reports were also forwarded to the petitioner. Ext.P22 order has been passed by the Board. Ext.P22 refers to the enquiry report with regard to the charges against the petitioner of the theft of money during the counting of Bhandaram at Chottanikkara Temple. It is stated in Ext.P22 that a fresh show cause notice had been issued to the petitioner along with copy of enquiry report and the reply submitted by the petitioner has been considered. It is stated that the petitioner
## **WP(C).No. 29945 of 2018 4**
had denied the statements in the show cause notice. However, it is found that the decisions taken by the Board after following due procedure to inflict punishments on the employee are due and proper. Petitioner was required to show cause against confirming the punishment.
4. The petitioner again submitted Ext.P23 reply dated 22.07.2015. However, Ext.P24 order has been issued on 15.09.2015, stating that the board by its proceedings dated 10.09.2015 has decided to approve the earlier penalties imposed on the petitioner. In respect of the first proceedings, while the petitioner was working as 'Masappady' at Thayankavu Devaswom, the decision to bar one increment with cumulative effect and to treat the period as eligible leave is confirmed. With regard to the second offence also, the decision to confirm the penalty of bar of three increments with cumulative effect and the decision taken to treat the suspension period as service break are confirmed. Thereafter, in response to Ext.P26 representation preferred by the petitioner in terms of Ext.P25 interim order, Ext.P27 order has again been issued stating that the petitioner is not entitled to any increments, since the increments have been barred in terms of the decision taken by the respondents.
## **WP(C).No. 29945 of 2018 5**
5. The learned counsel for the petitioner submits that the petitioner had, right from the beginning, been submitting that the proceedings against the petitioner in respect of the incident on 22.02.2007 were vitiated by mala fide as against him. The petitioner contended that the persons who were available in the premises at the time of counting, who had been shown as witnesses as against him had conspired against him and had attempted to make a false case of theft against him. It is submitted that Ext.P17 judgment in the criminal case, considered the very same aspects. The Chief Judicial Magistrate Court, after examining the entire evidence adduced, in detail, came to the conclusion that the mahazar prepared by the police did not even contain the number of the notes which were apparently seized from the petitioner. After considering the entire evidence, the criminal court came to the conclusion that there is merit in the contention of the counsel for the accused that PW1,PW2 and CW3 have planted persons who are loyal to them as witnesses to see that the accused is behind the bars **.** It was therefore found that the prosecution failed to prove the charges levelled against the accused beyond reasonable doubt. The accused was found not guilty of the offence punishable under Section 381 IPC and he was acquitted under Section 248 (1) Cr.P.C. This aspect of the matter has been clearly
## **WP(C).No. 29945 of 2018 6**
brought to the notice of the Board by the petitioner in Ext.P21 reply submitted to the show cause notice and later in Ext.P23 reply. However, there is no whisper on this aspect either in Ext.P22 or Ext.P24 orders passed by the Board.
6. A counter affidavit has been placed on record by the 1[st] respondent contending that all aspects of the matter have been considered by the Board while passing Exts. P24 and P27 orders. It is stated that the petitioner is not entitled to reinstatement or exoneration from the disciplinary proceedings only on account of an order of acquittal in a criminal proceedings. It is stated that full fledged enquiry has been conducted and the petitioner had been issued with copy of enquiry report as well. It is stated that the standard of proof in a criminal proceedings and in a disciplinary proceedings are entirely different and that the acquittal in a criminal proceedings will not have the effect of exoneration of the employee in a disciplinary proceedings. It is also contended that the Board, after examining the matter, found that unless orders of penalty are passed in cases of this nature, it will send a wrong signal to the employees of the Board. The learned Standing Counsel relied on the decision of the Apex Court in _**Union of India and Another v. Bihari Lal sidhana [(1997) 4 SCC 385] and S.Bhaskar Reddy and Another v.**_
## **WP(C).No. 29945 of 2018 7**
## _**Superintendent of Police and Another**_ [( _**2015) 2 SCC 365]**_ .
7. I have considered the contentions advanced on either side and perused the enquiry report as well as the impugned orders in detail. This Court in Ext.P18 judgment found that the proceedings against the petitioner were vitiated in the sense that the penalties had been inflicted without following the due procedure as provided in Rule 15 of Kerala Civil Services (Classification, Control & Appeals) Rules, which are applicable to the petitioner. The petitioner was therefore directed to be given copies of enquiry report and fresh show cause notice. What was contemplated therefore was a proper consideration of all the contentions raised by the petitioner as against the enquiry report. An order was directed to be passed after considering all the aspects of the matter. The petitioner, in his reply to the show cause notice issued to him in respect of the second disciplinary enquiry, has specifically pointed out that he has been honourably acquitted by Ext.P17 judgment by the criminal court. I notice that the witnesses who had been examined before the Criminal Court and whose testimony was not found acceptable by that Court are substantially the same witnesses, who have been examined by the enquiry officer in the enquiry proceedings as well. It is true that the enquiry proceedings have been finalized in 2011. However, the petitioner had apparently
## **WP(C).No. 29945 of 2018 8**
been given a copy of the enquiry report only along with Exts.P19 and P20 show cause notices. The petitioner, in his reply, has specifically pointed out the fact of his acquittal. It is evident from a reading of Exts.P22 and P24 orders that the decision of the Board was a forgone conclusion. The contentions of the petitioner, especially his contention with regard to acquittal in the criminal proceedings have not been even mentioned by the respondents in the order passed by them. The respondents have proceeded on the basis that the petitioner is guilty as charged. The impact of the acquittal in the criminal proceedings had been initiated against the petitioner on the self save charges which has led to the disciplinary proceedings has not been considered by the respondents at all.
8. In the above view of the matter, I am of the opinion that Ext.P17 judgment acquitting the petitioner is definitely a matter which should have been duly considered by the respondents. The decision taken to confirm the earlier decision taken by the Board which had been set aside by this Court on the ground of non compliance with the procedural requirements, without adverting to the specific contentions of the petitioner, according to me, does not amount to a proper compliance with Ext.P18 judgment. The non consideration of Ext.P17 also vitiates the orders passed by the respondents.
## **WP(C).No. 29945 of 2018 9**
In the above view of the matter, the impugned orders are set aside. The Board is directed to take up the reply given by the petitioner to the show cause notices issued to him, hear the petitioner and consider the matter afresh. The contentions of the petitioner that he had been honourably acquitted by Ext.P17 proceedings shall be specifically taken note of by the respondents and the judgment in its entirety shall be gone into by the Board before taking a decision in the matter. The contentions of the petitioner offered as explanation in response to Exts.P19 and P20 show cause notices shall also be referred to and an informed decision shall be taken by the Board within a period of two months from the date of receipt of a copy of this judgment.
The writ petition is ordered accordingly.
